Xxxxxx Equipment definition

Xxxxxx Equipment means a hardware device manufactured by Xxxxxx that supports only one (1) user of the Xxxxxx Software, per license, at any given time, a subassembly of such device, or a spare part for such device.

Xxxxxx Equipment means the ASU, the Existing Xxxxxx Liquid Facility, the Additional Oxygen Equipment, and the Xxxxxx Pipelines, collectively. Xxxxxx Pipelines means pipelines suitable for use in connection with the delivery of Product under this Agreement, owned or leased and operated and maintained by Xxxxxx, which connect the Xxxxxx Equipment to Coffeyville Resources’ Pipelines.

Xxxxxx Equipment means the equipment owned by the Xxxxxx Co-venturers listed and/or described at Exhibit B. "Xxxxxx Facilities" are as described at Exhibit A and means all the Contractor's Equipment and all the Xxxxxx Equipment.

• Central Xxxxxx shall, at appropriate intervals and in accordance with Good Utility Practice, maintain, test, calibrate, adjust, repair, and replace the Central Xxxxxx Equipment.

• The Central Xxxxxx Equipment shall be installed in the Central Xxxxxx Substation and on the Easement Area.

• Con Edison shall operate the Con Edison Equipment, and Central Xxxxxx shall operate the Central Xxxxxx Equipment.

• If Xxxxxx Equipment is stored for ninety (90) days or more, the Xxxxxx Equipment will be returned to Xxxxxx' facility to undergo quality assurance procedures prior to reshipment.

• For purposes hereof, the issuance of any security of Xxxxxx Equipment convertible into or exercisable or exchangeable for Common Stock shall result in an adjustment to the Fixed Conversion Price upon the issuance of such securities.

Xxxxxx Equipment has the meaning set forth in Section 6.7

Xxxxxx Equipment means the dyeing Machinery and Equipment located at the Xxxxxx Facility and designated on Schedule 4.4(c) as located at the Xxxxxx Facility.

Xxxxxx Equipment means all machinery, equipment, furniture, vehicles and other similar tangible assets located at the Facilities, including manufacturing, packaging and labeling equipment for the production of solid and liquid products, equipment for various utilities, boilers, compressors and water systems, tools, laboratory equipment and accessories, including without limitation, the equipment identified on Exhibit C, except (a) the Par Equipment, (b) the assets identified on Exhibit D and (c) the Inventory.

Xxxxxx Equipment has the meaning set out in Section 4.17(c).

Xxxxxx Equipment shall have the meaning set forth in Article 2.1(a)(i).

Xxxxxx Equipment means all machinery, equipment, furniture, and furnishings used in the Xxxxxx Business, including, without limitation, the items more particularly described in Schedule “E” hereto;

Xxxxxx Equipment means equipment more particularly described on Schedule A attached to and made a part of this Agreement as well as Xxxxxx equipment acquired by Borrower after the date hereof.
