Common use of Exclusivity Clause in Contracts

Exclusivity. Cdiscount Advertising is not granting the Customer any exclusivity and cannot guarantee that the Advertiser’s competing advertisers are not benefitting from the same Service during a given period, and in particular that they are not present on advertising spaces that are neighboring or contiguous with those of the Advertiser over a given period. An exclusivity provision in the Advertiser’s favor could potentially be negotiated, and in such a case would be subject to special terms and conditions under the Inclusion Order.
