Common use of Licence d’évaluation Clause in Contracts

Licence d’évaluation. Si un Logiciel est concédé au Client dans le cadre d’une licence d’évaluation, le Client, NONOBSTANT CERTAINES DISPOSITIONS CONTRAIRES DANS LE CONTRAT, accepte que : (I) Le Client soit autorisé à utiliser le Logiciel dans le cadre d’une utilisation non-commerciale et pour des besoins de démonstration ; (II) la durée de la licence de évaluation/test soit déterminée dans l’Order Schedule mais elle ne pourra jamais excéder une période de quatre-vingt dix (90) jours ; (III) le Logiciel est fourni «tel quel», sans garantie d'aucune sorte ; (IV) MSC n’a aucune obligation de fournir un Support sur de tels Logiciels. 4.4 Evaluation License. If Software is licensed to Customer under an Evaluation License, Customer agrees that, NOTWITHSTANDING ANYTHING TO THE CONTRARY ELSEWHERE IN THIS AGREEMENT: (I) Customer may use such Software for evaluation, non-production purposes only; (II) the term (duration) of the evaluation license shall be as set forth in the Order Schedule but shall in no event exceed ninety (90) days; (III) such Software is provided on an "as is" basis, with no warranties of any kind; and (IV) MSC has no obligation to provide any Support for such Software.
