About Replacements. If We determine that Your original Product needs to be replaced, We will make every reasonable effort to replace it with the same product; however, there may be some cases where it is impossible to procure an exact match (for example, the manufacturer may have deemed the model or color obsolete). In such situations, We will provide You with a replacement that is at least of equal features and functionality, but it may be a different brand, model, color or size as Your original Covered Product, and may be new, used, or refurbished. NOTICE: If the Covered Product is comprised of multiple items forming a matching set, once an affected piece has been replaced, that replacement piece will not be eligible for coverage under this Service Agreement; however, any/all remaining original Products that are unaffected will continue to be covered for the remainder of Your Agreement Term. We will not replace or provide compensation for any unaffected Products that do not match a replacement item that We may provide. Any/all parts, components, or entire units for which We provide replacement will automatically become Our property entirely. ⯈ About Reimbursements. If We decide that providing You with reimbursement towards the replacement of Your original Covered Product is best, such reimbursement may come in the form of a store credit that must be used at the original Product purchase location, check, Retailer store credit, or gift card, and the value of such will in no event exceed the LIMIT OF LIABILITY of this Agreement.

Any and all parts or units replaced under the provisions of this Agreement become Our property in their entirety. • About Reimbursements: In the event We determine that Your Covered Product/Covered System cannot be repaired or feasibly replaced, We will determine the reimbursement amount based on standard Service costs for the same type of Breakdown or Claim, and deduct any previous Claims paid by Us the applicable Covered Product/Covered System, and provide You with the net amount. (Subject to the applicable Claim Maximum for the Covered Products/Covered Systems, as outlined in section “XI. LIMIT OF LIABILITY AND CONDITIONS”.)

If the Benchmark Replacement is Daily Simple SOFR, all interest payments will be payable on a quarterly basis.

  • Work Out of Classification (a) When an employee is assigned for a limited period to perform the duties of a position at a higher level classification for more than ten (10) consecutive calendar days (or the equivalent thereof for alternate or flexible schedules), the employee shall be paid five percent (5%) above the employee’s base rate of pay or the first step of the higher salary range, whichever is greater. When assignments are made to work out-of-classification for more than ten (10) consecutive calendar days (or the equivalent thereof for alternate or flexible schedules), the employee shall be compensated for all hours worked beginning from the first day of the assignment for the full period of the assignment. When an employee is assigned to work out-of- classification pending approval of a reclassification upward, the employee will be paid at the next higher rate of pay or first step of the higher salary range, whichever is greater. Agencies may provide an additional five percent (5%) differential if the work out-of-class would not result in additional compensation for the employee. Agencies must document the reasons for the exception. (b) An employee performing duties out-of-classification for training or developmental purposes shall be informed in writing of the purpose and length of the assignment during which there shall be no extra pay for the work. A copy of the notice shall be placed in the employee’s file. (c) An employee who is underfilling a position shall be informed in writing that they are an underfill, the reasons for the underfill, and the requirements necessary for the employee to qualify for reclassification to the allocated level. Upon gaining regular status and meeting the requirements for the allocated level of the position, the employee shall be reclassified. (d) Assignments of work out-of-classification shall not be made in a manner which will subvert or circumvent the administration of this Article.

  • Substitute Teaching An adjunct faculty member who is interested in a substitute teaching assignment may be assigned to teach as a substitute in a course section for which the adjunct faculty member is qualified to teach. Each semester an adjunct faculty member may submit to the appropriate Xxxx a written request, on a form provided by the College, which shall indicate his/her willingness and availability to act as a substitute teacher and a reliable means by which to contact the adjunct faculty member on short notice. An adjunct faculty member who is selected to substitute teach shall be paid in accordance with Article 8.4.

  • Selection of Subcontractors, Procurement of Materials and Leasing of Equipment The contractor shall not discriminate on the grounds of race, color, religion, sex, national origin, age or disability in the selection and retention of subcontractors, including procurement of materials and leases of equipment.
