ACCEPTANCES OF WORKS OF THE EXTENSION CONTRACTOR. 5.1 The Supplier is obligated to participate in all Acceptance procedures of the works performed by the Extension Contractor (“Acceptances of Works of the Extension Contractor”), directly related to or affecting the Deliveries, in particular if Guaranteed Parameters of the Deliveries are verified during the Acceptances of the Works of the Extension Contractor or if the Deliveries may be damaged during such acceptances. Such acceptances shall be carried out at the Place of DeliveriesConstruction Site or other agreed places. 5.2 The circumstance that the Employer will participate in the Acceptances of the Works of the Extension Contractor and inspections, trials, examinations, tests, checks and will approve, verify, accept or provide an opinion on the specific part of the works does not mean that the Employer completed the acceptance, assumed liability for the performance of the Works or released the Supplier from its obligations or any liability under the Contract. 5.3 The Supplier’s failure to participate in the Mechanical Commissioning and Process Commissioning, Performance Testing and Trial Run of the Investment Project shall not withhold the possibility of carrying them out, and all performed measurements, without the presence of the Supplier, shall become binding upon the Supplier. 5.4 The Employer shall inform the Supplier about the dates of the activities indicated in Art. 5.1 and Art. 5.3 at least 10 Business Days in advance.

  • Contract Extensions This Contract may be extended on an annual basis beyond the Initial Term if the Local Board successfully meets the terms of the Contract for at least three or more years as determined by the State Board.
