Access by Xxxxxxx. (a) Subject to Grantee’s compliance with the terms and provisions of this Agreement, until the earlier to occur of (i) ; or (ii) the earlier termination of this Agreement, Grantee and Xxxxxxx’s agents, employees, contractors, representatives and other designees (herein collectively called “Grantee’s Designees”) shall have the right to enter upon the Property for the purpose of picking up and dropping off students that are enrolled in Lincoln County School District No. 2 and other school bus activities. (b) Xxxxxxx expressly agrees as follows: i. No personal property of any nature including but not limited to vehicles and/or equipment shall be stored on the real property described in Exhibit A. ii. Xxxxxxx agrees that they will provide snow removal on the real property described in Exhibit A any time there is more than two inches of accumulation of snow and have the removal completed thirty minutes prior to any scheduled bus stop on the real property described in Exhibit A. iii. The real property described in Exhibit A will consist of at least thirty (30) by fifty (50) feet to allow a three-point turnaround by a Lincoln County School District No. 2 bus or if the real property described in Exhibit A shall be used as a turnaround (cul-de-sac) it shall be at least sixty (60) feet in radius. • Xxxxxxx agrees to the thirty (30) by fifty (50) foot three-point turnaround (please initial) • Grantee agrees to the sixty (60) foot cul-de-sac turnaround (please initial) iv. The real property as described in Exhibit A shall be free from debris and maintained in a level and reasonable condition. Specifically, but not limited to a smooth surface preventing the accumulation of mud and which would allow the bus driver to turn the bus around on the real property described in Exhibit A without concern for becoming stuck or damaging the bus. v. That the snow removal and prohibition to vehicle and equipment storage will apply only during the school days of the scheduled school year for students enrolled in Lincoln County School District No. 2.

Access by Xxxxxxx a. Subject to Grantee's compliance with the terms and provisions of this Agreement, until the earlier to occur of (i) the expiration of the Due Diligence Period (as defined in the Purchase Agreement); or (ii) the earlier termination of this Agreement, Grantee and Xxxxxxx's agents, employees, contractors, representatives and other designees (herein collectively called “Grantee's Designees”) shall have the right to enter upon the Property for the purpose of conducting the Due Diligence Activities. b. Grantee expressly agrees as follows: (i) any activities by or on behalf of Grantee, including, without limitation, the entry by Grantee or Xxxxxxx's Designees onto the Property in connection with the Due Diligence Activities shall not materially damage the Property in any manner whatsoever or disturb or interfere with the rights or possession of any tenant on the Property, (ii) in the event the Property is materially altered or disturbed in any manner in connection with the Due Diligence Activities, Grantee shall immediately return the Property to substantially the same condition existing prior to the Due Diligence Activities, and (iii) Grantee, to the extent allowed by law, shall indemnify, defend and hold Grantor harmless from and against any and all claims, liabilities, damages, losses, costs and expenses of any kind or nature whatsoever (including, without limitation, attorneys' fees and expenses and court costs) suffered, incurred or sustained by Grantor as a result of, by reason of, or in connection with the Due Diligence Activities or the entry by Grantee or Xxxxxxx's Designees onto the Property; provided, however, that in no event shall Grantee be liable for any liabilities, damages, losses, costs or expenses of any kind or nature that relate, directly or indirectly, to (y) consequential or punitive damages; or (z) matters that are merely discovered, but not exacerbated, by Xxxxxxx. Notwithstanding any provision of this Agreement to the contrary, Grantee shall not have the right to undertake any invasive activities or tests upon the Property, or any environmental testing on the Property beyond the scope of a standard “Phase I” investigation, without the prior written consent of Grantor of a workplan for such “Phase II” or invasive testing. If Granter does not respond or reject any workplan within ten (10) days of Xxxxxxx's delivery of the written workplan proposal to Grantor pursuant to the notice provisions of this Agreement, then Grantor shall be deeme...
Access by Xxxxxxx. Xxxxxxx, at reasonable times and frequency shall have the right to enter the Ground Lease Premises and Event Lease Premises, but not the improvements on the Ground Lease Premises used by Stampede for offices and storage, and to examine the same, to make any and all inspections and repairs, alterations, improvements or additions without constituting an eviction of Stampede in whole or in part. In no event shall such right be exercised in a manner that interferes with the business of Stampede or the Event.

  • Xxxxxxx Xxxx CareFirst BlueChoice’s Service Area is a clearly defined geographic area in which CareFirst BlueChoice has arranged for the provision of health care services to be generally available and readily accessible to Members. CareFirst BlueChoice will provide the Member with a specific description of the Service Area at the time of enrollment. The Service Area is as follows: the District of Columbia; the state of Maryland; in the Commonwealth of Virginia, the cities of Alexandria and Fairfax, Arlington County, the town of Vienna and the areas of Fairfax and Xxxxxx Xxxxxxxx Counties in Virginia lying east of Route 123. SAMPLE If a Member temporarily lives out of the Service Area (for example, if a Dependent goes to college in another state), the Member may be able to take advantage of the CareFirst BlueChoice Away From Home Program. This Program may allow a Member who resides out of the Service Area for an extended period of time to utilize the benefits of an affiliated Blue Cross and Blue Shield HMO. This Program is not coordination of benefits. A Member who takes advantage of the Away From Home Program will be subject to the rules, regulations and plan benefits of the affiliated Blue Cross and Blue Shield HMO. If the Member makes a permanent move, he/she does not have to wait until the Annual Open Enrollment Period to change plans.
