ACCESS TO PERSONNEL FOLDERS AND EVALUATIONS. A. A staff member shall, within five (5) working days of a written request to his or department, have an opportunity to review his/her central personnel history folder in the presence of an appropriate official of the department to examine any criticism, commendation or any evaluation of his/her work performance or conduct prepared by the Hospital during the term of this Agreement. Such examination shall not require a loss of paid time. If requested by the staff member, a non-staff member union representative may accompany the staff member. He/she shall be allowed to place in such file a response of reasonable length to anything contained therein. The Hospital will honor a request made by a staff member for a copy of any derogatory item included in that staff member's folder.

An employee shall within three (3) working days of a written request to the Personnel Department during the term of this Agreement, have an opportunity to review his/her personnel file, in the presence of an appropriate official of the Personnel Department, to examine any criticism commendation or evaluation of his/her work performance of conduct prepared by the Town. He/she shall be allowed to place in such file a response of reasonable length to anything contained therein.

Provision for such examination shall be during the employee's regular scheduled hours of work and shall not require a loss of paid time. He shall be allowed to place in such file a response of reasonable length to anything contained therein. If any material derogatory to the employee is placed in his file, a copy of such material shall be sent to the employee. A copy of all material placed in an employee’s work history by the employer shall be made available to the employee. The employee shall sign a receipt for such material, which shall be placed in the employee’s file. A copy of the receipt should also be provided to the employee by the employer.

Each employee shall, if he requests, be given an opportunity to review any evaluation of his work performance or conduct prepared during the term of this Contract and included in his permanent personnel folder or permanent supplementary personnel file known as a unit or cottage file. He may file a written response to such materials and, if requested, such response will be attached to and retained with the particular instrument concerned. Any records concerning the performance or conduct of an employee that are passed from one (l) supervisor to another upon the transfer of an employee or his/her supervisor will be available for review by the employee upon request. The requests for review as outlined in this paragraph shall be honored in an expeditious fashion.

ACCESS TO PERSONNEL FOLDERS AND EVALUATIONS. A supervisor shall, within three working days of written request, have an opportunity to review his/her personnel file in the presence of a designated representative of the Authority to examine any criticisms, recommendations or any performance evaluations or conduct evaluations prepared by the Authority during the term of this Agreement. The supervisor shall be allowed to submit a written response to address anything contained in the personnel file. The supervisor’s response will be placed in the personnel file as a matter of record.

ACCESS TO PERSONNEL FOLDERS AND EVALUATIONS. Each Employee shall, upon reasonable notice, be given an opportunity to review any evaluation of the Employee's work performance or conduct prepared during the term of this Contract and included in their permanent personnel folder. The Employee may file a written response to such materials and, if required, such response will be attached to and retained with the particular instrument performance. Each regular written evaluation of work performance shall be reviewed with the Employee and evidence of this review shall be the required signature of the Employee on the evaluation form. Such signature shall not be construed to mean agreement with the content of the evaluation unless such agreement is stated thereon. No document of anonymous origin shall be used against any Employee. Copies of any written documents specifically related to discipline or the work performance of any Employee which are relied upon by the Employer during any disciplinary proceeding, grievance hearing or in any final evaluation report will be given to the Employee.
