Access to PHI by Individuals. A. Upon request, Business Associate agrees to furnish Covered Entity with copies of the PHI maintained by Business Associate in a Designated Record Set in the time and manner designated by Covered Entity to enable Covered Entity to respond to an Individual’s request for access to PHI under 45 CFR §164.524. B. In the event any Individual or personal representative requests access to the Individual’s PHI directly from Business Associate, Business Associate within 10 business days, will forward that request to Covered Entity. Any disclosure of, or decision not to disclose, the PHI requested by an Individual or a personal representative and compliance with the requirements applicable to an Individual’s right to obtain access to PHI shall be the sole responsibility of Covered Entity.

Access to PHI by Individuals. The Business Associate shall cooperate with the Department to fulfill all requests by individuals for access to the individual’s PHI that are approved by the Department. Access to PHI by Individuals. Contractor shall cooperate with BHL to fulfill all requests by individuals for access to the individual’s PHI in a Designated Record Set that are approved by BHL. Contractor shall cooperate with BHL in all respects necessary for BHL to comply with applicable Privacy Laws. Because California law requires that copies of requested records be forwarded to patients within fifteen (15) days of their request, Contractor agrees to forward any copies requested by BHL for this purpose within 5 business days. If Contractor receives a request from an individual for access to PHI, Contractor promptly shall forward such request to BHL and await BHL’s instructions with respect to denial or approval of such request. BHL shall be solely responsible for determining the scope of PHI and Designated Record Set with respect to each request by an individual for access to PHI. Upon instruction from BHL, Contractor shall deny such individual’s request or fulfill such individual’s request by providing such individual’s PHI to such individual. BHL shall reimburse Contractor a portion of the fee charged by BHL to the individual that is proportional to the amount of PHI produced by Contractor in relation to the amount of PHI produced by BHL, less reasonable BHL administrative expenses.

If MAG receives a request from an individual for access to PHI, MAG immediately shall forward such request to Physician Practice. Physician Practice shall be solely responsible for determining the scope of PHI and Designated Record Set with respect to each request by an individual for access to PHI.

Company shall be solely responsible for determining the scope of PHI and Designated Record Set with respect to each request by an individual for access to PHI. <If Contractor maintains PHI in a Designated Record Set on behalf of Company, Contractor shall permit any individual, upon notice by Company, to access and obtain copies of the individual’s PHI in accordance with 45 C.F.R. 164.524. Contractor shall make the PHI available in the format requested by the individual and approved by Company, unless the PHI is not readily producible in such format, in which case the PHI shall be produced in hard copy format. Contractor may not charge the individual any fees for such access to PHI.> Company shall reimburse Contractor a portion of the fee charged by Company to the individual that is proportional to the amount of PHI produced by Contractor in relation to the amount of PHI produced by Company.

Business Associate shall respond to the individual's request only upon direction by Covered Entity. The decision to disclose PHI requested by an individual or a personal representative shall be determined solely by the Covered Entity.
Access to PHI by Individuals. Business Associate agrees to provide access, at the request of EMS Agency and during normal business hours, to PHI in a Designated Record Set to EMS Agency or, as directed by EMS Agency, to an Individual or an Individual’s designee in order to meet the requirements of Section 164.524 of the CFR provided that EMS Agency delivers to Business Associate a written notice at least five (5) business days before the date on which access is requested. Subject to such notice requirements, Business Associate shall permit an Individual or an Individual’s designee to inspect and copy PHI pertaining to such Individual in Business Associate's custody or control. Business Associate shall establish procedures for access to the PHI maintained by Business Associate in Designated Record Sets in the time and manner designated by EMS Agency to enable EMS Agency to fulfill its obligations under the HIPAA Rules. Business Associate shall produce PHI in electronic format if Individual requests such PHI to be delivered in such format and the PHI is readily producible in such format.
