Adapters. The Service may include access to certain Adapters and will be identified in the applicable Order Form. Inriver grants Subscriber a limited, non-exclusive, revocable and non-transferable license to use the Adapters as set forth in the Order Form and solely in relation to its access to and use of the Service during the applicable Subscription Term. Notwithstanding anything herein to the contrary, Inriver shall have no liability for: (i) the functionality of the Adapters, or loss of access to any Adapters, if any third-party APIs or services are changed or discontinued; (ii) the Adapter in case the Subscriber alters or modifies any source code which Inriver may give or directed Subscriber access to related to the Adapters or other sub-components; nor

Inriver grants Subscriber and its Authorized Users a limited, non-exclusive, revocable and non- transferable license to use the Adapters as set forth in the Order Form and solely in relation to its access to and use of the Service during the applicable Subscription Term. Notwithstanding anything herein to the contrary, Inriver shall have no liability for: (i) the functionality of the Adapters, or loss of access to any Adapters, if any third-party APIs or services are changed or discontinued; (ii) the Adapter in case the Subscriber alters or modifies any source code which Inriver may give or directed Subscriber access to related to the Adapters or other sub-components; nor (iii) any Subscriber Content transferred to a third party. Certain Adapters require a valid subscription or license to the third party service to which the Adapter links and Subscriber shall be liable for all costs related thereto. Subscriber, on behalf of itself and its Authorized Users, represents and warrants that it has all requisite rights to access such third party services in connection with its use of the Adapter and shall indemnify, defend and hold harmless Inriver for any failure thereof and all damages related thereto.
Adapters. You are solely responsible for any Adapter that you Make Available on or through the Services, including without limitation for securing any rights or licenses in connection with such Adapter and Xxxxxx’s use thereof. You acknowledge and agree that Xxxxxx has no obligation to publish or otherwise make your Adapter available on or through the Services. Licensee’s license and use of certain Progress® Apama® products which link to third party systems and/or data feeds (“Adapters”) may be subject to Licensee being appropriately licensed for the third party systems and/or datafeeds connected by such Adapters. Separate agreements with such third parties may be required. The terms of this Agreement shall apply to all Progress® Apama® Adapters used in connection with the Products. b. If the Product identified in the Order is a Progress® Apama® Adapter, then the Product is licensed under the Instance license model described below. As a pre-requisite, Licensee must have a valid license for the Progress Apama® Platform for Capital Markets product. If Licensee’s license for the Progress® Apama® Platform for Capital Markets product is based on a Platform license model, then Licensee’s license for the Progress® Apama® Adapter will be limited to use only in conjunction with the Progress® Apama® Platform product subject to Licensee’s compliance with the Platform license model restrictions and all other usage limitations applicable to Licensee’s license for the Progress® Apama® Platform for Capital Markets product. If Licensee’s license for the Progress® Apama® Platform for Capital Markets product is based on a Core license model, then Licensee’s license for the Progress® Apama® Adapter will be limited to use only in conjunction with the Progress® Apama® Platform product subject to Licensee’s compliance with the Core license model restrictions and all other usage limitations applicable to Licensee’s license for the Progress® Apama® Platform for Capital Markets product.

The Tailgating Services provided by TAILGATE GUYS pursuant to this Agreement may, at the option of CLIENT and subject to availability, include a media package comprised of a television, stand, connection to a satellite, connection to a receiver, and power source (a “Media Package”).
