Where the Consultant does not submit his valid tax invoice in accordance with the law within the time required the period within which payment is made in terms of clause 51.1, the period within which payment is made in terms of clause 51.1 and the time allowed in clause 90.4 are extended by the length of time from the date when the Consultant should have submitted the valid tax invoices to the date when he does submit it. Z2 Acts or omissions by mandatories In terms of Section 37(2) of the Occupational health and Safety Act of 1993 (Act 85 of 1993), the Consultant hereby agrees that the Client is relieved of any and all of its liabilities in terms of Section 37(1) of this Act in respect of any acts or omissions of the Consultant and his employees to the extent permitted by this Act, and that this contract comprises the written agreement between the Client and the Consultant contemplated in section 37(2). Z3 Publicity and disclosure of information 1) The Parties do not disclose information obtained in connection with the service except when necessary to carry out their duties under this contract. 2) The Consultant may publicise the service only with the Client’s written agreement. Each Option Z provision will apply unless deleted below or in the list of Option Z provisions which appears in “CONTRACT DATA Part One – Data provided by the Employer, 1 General, Option Z: Additional conditions of contract”.

The dispensers shall be installed free of any cost / charge and shall be periodically maintained / calibrated / replaced for proper functioning and accurate dosing for optimum performance. 7. The lists of Chemical/Reagents are indicative. 8. Chemical reagents must be procured from Authorized dealer / distributor of the manufacturer and monthly bills submitted to JMRC shall be accompanied with material inward Challan copies and Distributor Authorization letter copy from the manufacturer 9. Before the initiation of contract, Bidder shall submit samples of chemical reagent & dilutor to JMRC to obtain prior approval of using the same. JMRC reserves the right to accept or decline the items. 10. The contractor shall procure one month’s stock in advance and the same shall be kept under the custody of JMRC. 11. Contractor shall be determine & inform JMRC of a particular date of month on which or before it, the full quantity of chemical regents shall be brought in to the station controller to verify the same. 12. Additional conditions of contract. The Option Z clauses, contained in Contract Schedule B, supplement, modify or replace the normal published provisions of the NEC3 Term Service Contract (the “NEC3 TSC”). Contract Schedule B states that each Option Z provision will apply unless deleted in the Schedule or in the list of Option Z provisions which appears in “CONTRACT DATA Part One – Data provided by the Employer, 1 General, Option Z: Additional conditions of contract”. However, in the interests of complete certainty, any Option Z clauses that are not to apply should be deleted in both the list and the Schedule. To assist users to prioritise their review of the optional provisions, the provisions are grouped into 3 categories of applicability and/or importance, the provisions in section 1 being considered to be useful and appropriate in almost all contracts (each option should therefore ordinarily be retained), those in section 2 being considered useful and appropriate in a number of circumstances but not all (each option will therefore require consideration in light of the circumstances of each intended contract), whilst those in section 3 are considered appropriate only in relatively limited circumstances (and therefore should ordinarily be deleted). Users should note that many of the numbered Option Z provisions which appear in Contract Schedule B contain two or more clauses. Users should utilise or delete each individual option Z provision in its entirety, rather than deleting some clauses from an option whilst retaining others.
