Common use of Adoption/Paternity Leave Clause in Contracts

Adoption/Paternity Leave. (a) An Employee who has completed her or his probationary period shall, upon written request, be granted leave without pay and benefits for up to 12 months that is necessary for the purpose of adopting a child or for parenting duties following the birth of a child. An Employee on such leave shall provide the Employer with at least two weeks written notice of readiness to return to work. The Employer shall reinstate the Employee in the same position held by her or him immediately prior to taking leave, or, if such is not possible, provide the Employee with alternate work of a comparable nature at not less than the same step in the pay scale and other benefits that accrued to the Employee up to the date leave commenced. (b) The Employee may commence adoption leave upon one days notice provided that application for such leave is made when the adoption has been approved and the Employer is kept informed of the progress of the adoption proceedings. (c) The Employee may commence paternity leave with one days notice provided that the initial application for such leave is made 12 weeks prior to the expected date of delivery. (d) Benefits coverage will continue at pre-leave cost-share arrangements for 12 full weeks of adoption/paternity leave provided that the Employee makes arrangements to prepay their share of the premium prior to the commencement of the adoption/paternity leave.
