Common use of Adoption/Paternity Leave Clause in Contracts

Adoption/Paternity Leave. (a) An Employee shall, upon written request, be granted leave without pay and benefits for up to twelve (12) months that is necessary for the purpose of adopting a child or for parenting duties following the birth of a child. An Employee on such leave shall provide the Employer with at least two (2) weeks written notice of readiness to return to work. The Employer shall place the Employee in the same position held by her or him immediately prior to taking leave, or, if such is not possible, provide the Employee with alternate work of a comparable nature at not less than the same step in the pay scale and other benefits that accrued to the Employee up to the date the Employee commenced leave.

The Employer shall place the Employee reinstate her in the same position held by her or him immediately prior to taking leave, or, if such is not possible, provide the Employee her with alternate work of a comparable nature at not less than the same step in the pay scale and other benefits that accrued to the Employee her up to the date the Employee she commenced leave.
