Agency/Stakeholder Tracking. The ENGINEER shall develop and maintain a database of contacts, in coordination with the STATE as described below:  Federal, Tribal, State and Local Elected and Public Officials – this list shall contain elected and public officials who represent constituents in the Study Corridor and/or who may have interest in the study. Contacts on this list shall receive communications via letter from the STATE at study initiation, at key decision points in the planning process, as needed, and at the conclusion of the study.  Federal and State Agencies – this list will contain the local/regional contacts of resource agencies that have jurisdiction in the study area and whom may have interest in the study. Contacts on this list shall receive communications via letter from the STATE at study initiation, at key decision points in the planning process, as needed, and at the conclusion of the study.  Agency Working Group (AWG) – this list shall contain AWG members including city, county, regional, tribal, and other stakeholder contacts, as identified through coordination with the STATE. Contacts on this list shall receive communications from the Study Team via email regarding AWG and public meetings and other key study updates.  Texas Department of Transportation (TxDOT) Staff – this list shall contain TxDOT staff with a role in the study and/or those who have interest, as identified by the STATE. Contacts on this list shall receive communications from the Study Team via email regarding AWG and public meetings and other key study updates.  Public – this list shall contain the names and email addresses of members of the public who chose to receive email updates about the study. Contacts on this list shall receive communications from the Study Team via email regarding public meetings and other key study updates (duration of 18 months).  Adjacent Property Owners – this list shall contain the names and mailing addresses of those that own property adjacent and within ½ mile of the Study Corridor. Contacts on this list shall receive mailed and/or email communications from the STATE, such as postcards regarding notification of public meetings. The ENGINEER shall provide the mailing list; the STATE will create and mail the post card. The ENGINEER shall prepare a draft contact list for the STATE to review.   • Agency Cross Transactions From time to time, the Advisor or brokers or dealers affiliated with it may find themselves in a position to buy for certain of their brokerage clients (each an "Account") securities which the Advisor's investment advisory clients wish to sell, and to sell for certain of their brokerage clients securities which advisory clients wish to buy. Where one of the parties is an advisory client, the Advisor or the affiliated broker or dealer cannot participate in this type of transaction (known as a cross transaction) on behalf of an advisory client and retain commissions from one or both parties to the transaction without the advisory client's consent. This is because in a situation where the Advisor is making the investment decision (as opposed to a brokerage client who makes his own investment decisions), and the Advisor or an affiliate is receiving commissions from both sides of the transaction, there is a potential conflicting division of loyalties and responsibilities on the Advisor's part regarding the advisory client. The Securities and Exchange Commission has adopted a rule under the Investment Advisers Act of 1940, as amended, which permits the Advisor or its affiliates to participate on behalf of an Account in agency cross transactions if the advisory client has given written consent in advance. By execution of this Agreement, the Trust authorizes the Advisor or its affiliates to participate in agency cross transactions involving an Account. The Trust may revoke its consent at any time by written notice to the Advisor.

  • PayPal’s Buyer Protection Program When you buy something from a seller who accepts PayPal, you may be eligible for a refund under PayPal’s Buyer Protection program. When applicable, PayPal’s Buyer Protection program entitles you to reimbursement for the full purchase price of the item plus the original shipping costs you paid, if any. PayPal determines, in its sole discretion, whether your claim is eligible for PayPal’s Buyer Protection program.   • Program Monitoring The Contractor will make all records and documents required under this Agreement as outlined here, in OEC Policies and NHECC Policies available to the SRO or its designee, the SR Fiscal Officer or their designee and the OEC. Scheduled monitoring visits will take place twice a year. The SRO and OEC reserve the right to make unannounced visits.

  • STATEWIDE CONTRACT MANAGEMENT SYSTEM If the maximum amount payable to Contractor under this Contract is $100,000 or greater, either on the Effective Date or at any time thereafter, this section shall apply. Contractor agrees to be governed by and comply with the provisions of §§00-000-000, 00-000-000, 00-000-000, and 00- 000-000, C.R.S. regarding the monitoring of vendor performance and the reporting of contract information in the State’s contract management system (“Contract Management System” or “CMS”). Contractor’s performance shall be subject to evaluation and review in accordance with the terms and conditions of this Contract, Colorado statutes governing CMS, and State Fiscal Rules and State Controller policies.

  • Evaluation, Testing, and Monitoring 1. The System Agency may review, test, evaluate and monitor Grantee’s Products and services, as well as associated documentation and technical support for compliance with the Accessibility Standards. Review, testing, evaluation and monitoring may be conducted before and after the award of a contract. Testing and monitoring may include user acceptance testing. Neither the review, testing (including acceptance testing), evaluation or monitoring of any Product or service, nor the absence of review, testing, evaluation or monitoring, will result in a waiver of the State’s right to contest the Grantee’s assertion of compliance with the Accessibility Standards. 2. Grantee agrees to cooperate fully and provide the System Agency and its representatives timely access to Products, records, and other items and information needed to conduct such review, evaluation, testing, and monitoring.

  • E-Verify Program Grantee certifies that it utilizes and will continue to utilize the U.S. Department of Homeland Security's E-Verify system to determine the eligibility of: A. all persons employed to perform duties within Texas during the term of the Grant Agreement; and B. all persons, (including subcontractors) assigned by the Grantee to perform work pursuant to the Grant Agreement within the United States of America.

  • Quality Management System Supplier hereby undertakes, warrants and confirms, and will ensue same for its subcontractors, to remain certified in accordance with ISO 9001 standard or equivalent. At any time during the term of this Agreement, the Supplier shall, if so instructed by ISR, provide evidence of such certifications. In any event, Supplier must notify ISR, in writing, in the event said certification is suspended and/or canceled and/or not continued.
