Agrichemical Use Sample Clauses

Agrichemical Use. 15.1 The Grower acknowledges that the Grower is aware of clause A17 of the ZGL Contract and agrees the Grower shall not apply to their crop: a. Any agrichemical or compound that is not permitted for use on kiwifruit under the ZGL Crop Protection Programme or by law; or b. A permitted agrichemical or compound where it is applied otherwise than in accordance with the conditions listed in the ZGL Crop Protection Programme or under any regulatory approval provided by law. 15.2 The Grower acknowledges that if any of the Grower’s kiwifruit is found to contain any residue of an agrichemical or compound that is not permitted under the ZGL Crop Protection Programme or by law such that it is “Non-Compliant Fruit” in terms of clause A17 of the ZGL Contract, that the provisions of clause A17of the ZGL Contract will apply. 15.3 ZGL has a discretion to purchase non-compliant fruit under clause A17.5 If ZGL exercises its discretion to purchase any of the Grower’s non-compliant fruit under clause A17.5 of the ZGL Contract, such fruit will be purchased as Non Standard Supply under an SLA and the Grower will bear the costs of: a. any additional residue tests required; b. any pack transfers or additional conditions of export; c. if imposed by XXX, a penalty of $0.20 per TE; and d. any other additional costs incurred by XXX. 15.4 The Grower acknowledges and agrees that: a. Where the Grower’s fruit is found to be non-compliant, the Grower is responsible for the costs associated with such non-compliant fruit, and the Grower agrees to co-operate with ZGL and the Registered Supplier to work out a cost repayment schedule; b. Where costs incurred under clause A17 are not recovered directly from the Grower, and where ZGL exercises its rights pursuant to the ZGL Contract to set off, deduct, or recover as an overpayment, liability for costs incurred under clause A17 of the ZGL Contract against payments due to the Registered Supplier for fruit supplied on behalf of Growers, or where ZGL invoices the Registered Supplier for “Direct Costs” (as defined in A17.3) the Registered Supplier shall seek to recover any such liability from the relevant Grower(s) concerned pursuant to the indemnity provided at clause 15.5 with the assistance of XXX; c. Where costs cannot be recovered from the Grower pursuant to clause 15.5, the liability for such costs shall be shared equally by the ZGL pool in the manner provided for at clause A17.12 of the ZGL Contract.   • Commercial Use the use of the Licensed Material for the purpose of monetary reward (whether by or for the Institution or an Authorised User) by means of sale, resale, loan, transfer, hire or other form of exploitation of the Licensed Material. For the avoidance of doubt, the use by the Institution or Authorised Users of the Licensed Material in the course of research funded by a commercial organisation is not deemed to constitute Commercial Use. Recovery of costs is not being deemed Commercial Use.

  • Residential Use; Pets The bedroom space and apartment may be used solely for private residential purposes and for no other purposes. Resident may not carry on any business or other enterprise from the bedroom space or apartment, nor use any Owner- provided Internet connections for business purposes. Resident may place no signs, placards or other advertisement of any character in the bedroom space or apartment, nor display anything in an apartment or bedroom space that is visible from outside the Property or the apartment. Resident may not store at the Property or connect to a Property electrical outlet any mobility device owned by a third party. Pets are permitted in or about the Property only in specified buildings as Owner may in its discretion allow residents to maintain, in each case only following Owner's signature on a Pet Addendum for a single dog or cat per designated apartment, which requires payment of a registration fee and pet rent as provided in the Pet Addendum. All other pets are prohibited anywhere at the Property, except fish in small tanks to the extent approved by Owner in its sole discretion. Violation of the pet policy will subject Resident to deep-cleaning and daily administration fees in Owner’s discretion and may be considered as a termination of this Housing Agreement by Resident.

  • SINGLE-USE PRODUCTS The Board of County Commissioners has established a single-use products and plastic bags policy intended to reduce the use of products which have become globally recognized as having lasting negative impacts on the environment. Neither single-use products nor plastic bags may be sold or disbursed on County property by staff or contracted vendors, except as set forth in Orange County Administrative Regulation 9.01.03. Failure to comply with the Regulation may result in termination of the contract or other contractual remedies, and may affect future contracting with the County. The use of reusable, recyclable, biodegradable, or compostable materials is encouraged.

  • Influenza Vaccine Upon recommendation of the Medical Officer of Health, all employees shall be required, on an annual basis to be vaccinated and or to take antiviral medication for influenza. If the costs of such medication are not covered by some other sources, the Employer will pay the cost for such medication. If the employee fails to take the required medication, she may be placed on an unpaid leave of absence during any influenza outbreak in the home until such time as the employee has been cleared by the public health or the Employer to return to the work environment. The only exception to this would be employees for whom taking the medication will result in the employee being physically ill to the extent that she cannot attend work. Upon written direction from the employee’s physician of such medical condition in consultation with the Employer’s physician, (if requested), the employee will be permitted to access their sick bank, if any, during any outbreak period. If there is a dispute between the physicians, the employee will be placed on unpaid leave. If the employee gets sick as a reaction to the drug and applies for WSIB the Employer will not oppose the application. If an employee is pregnant and her physician believes the pregnancy could be in jeopardy as a result of the influenza inoculation and/or the antiviral medication she shall be eligible for sick leave in circumstances where she is not allowed to attend at work as a result of an outbreak. This clause shall be interpreted in a manner consistent with the Ontario Human Rights Code.
