Alternate Shift Scheduling. (a) Management, the Plant Committee and the Local Union shall have the right, under the terms of the Col- lective Agreement, to agree upon and implement, other schedules which, except for production shifts in manu- facturing operations, may include Sundays, without overtime penalty, provided the principle of the forty (40) hour week is maintained over an averaging period. Rate and one-half shall be paid for hours worked on Sunday except in case of Graveyard shift starting on Sunday evening, when a straight time rate shall be paid to a maximum of one and one-half hours. (b) When alternative schedules have been implemented in accordance with (a) above, the following overtime pro- visions will apply. Rate and one-half shall be paid for the following: (i) The first three (3) hours worked in a day in excess of the normal daily hours of the established schedule. (ii) Hours worked in excess of forty (40) hours per week or forty (40) hours average when there is an averaging period. (iii) All hours worked on an Employee’s scheduled rest day, unless a change in rest day has been agreed to between the Employee and the Company. (iv) All hours worked on Sunday except those excluded in the casual section and also paragraph (a) above. (c) Double straight time rates shall be paid for the following: (i) All hours worked in excess of (i) above. (ii) All hours worked on Sunday when Sunday is also an Employee’s scheduled rest day, if the Employee has worked forty (40) straight time hours in the preceding six (6) days, unless a change in rest day has been agreed to between the Employee and the Company.

By agreement between the Parties, the issue of Alternate Shifts has been referred to the Special Mediators ( Xxxxx Ready and Xxxxxx Xxxxxx) for a final and binding resolution.
