Amendment to the Certificate of Designations. The Company will use its best efforts to file with the Secretary of State of the State of Delaware an amendment to the Certificate of Designations designating the Series D Preferred Stock to increase the number of shares so designated to include a number of shares sufficient the cover the Securities.
Amendment to the Certificate of Designations. The parties hereto hereby agree to amend the terms of the Preferred Stock as set forth in the Certificate of Designations of the Preferred Stock in the form attached hereto as Exhibit A (the “Amendment”).
