AND OTHER COMMUNICABLE DISEASES. I agree, understand, and acknowledge, that an inherent risk of exposure to the disease COVID-19 (as defined by the World Health Organization and any strains, variants, or mutations thereof) and SARS-CoV-2 (the virus that can cause COVID-19) (collectively, “COVID-19”), and any other communicable or infectious disease, exists in any public place where people are present. “Communicable disease” means any disease or illness caused by microorganisms such as bacteria, viruses, parasites, or fungi that can be spread, directly or indirectly, from one person to another. “Infectious disease” means any disease or illness caused by microorganisms such as bacteria, viruses, parasites, or fungi that enter the body, multiply, and can cause an infection. COVID-19 is an extremely contagious communicable disease that can lead to severe illness and death. No precautions can eliminate the risk of exposure to COVID-19, and the risk of exposure applies to everyone. According to the Centers for Disease Control and Prevention (“CDC”), older adults (people 65 years and older) and people of any age who have underlying medical conditions might be at higher risk for severe illness and death from COVID-19. I also acknowledge that the risk of exposure to COVID-19 and any other communicable or infectious disease includes the risk that you will expose others that you later encounter, even if you are not experiencing or displaying any symptoms of illness.

AND OTHER COMMUNICABLE DISEASES. Due to the nature of ship operations there is an increased risk of acquiring a communicable disease such as COVID-19. As such it is imperative to maintain ship hygiene and obey the orders of crew and Faculty and Staff Members to implement personal practices and assist others with maintaining a high degree of Vessel hygiene best practices. By signing this agreement, you accept this risk and understand that you have the right to defer your participation in the training cruise to a future training opportunity.
AND OTHER COMMUNICABLE DISEASES. I consider myself (or my minor child) in good health, am not contagious and have not experienced symptoms or signs that indic ate any form of illness, including (but not limited to) fever, cough or shortness of breath. I have not been around those who have shown symptoms of illness or have recently been sick. I will take the necessary prec autions as recommended by the Center for Disease Control to prevent the spread of illness in order to maintain a safe, healthy environment. I understand and a cknowledge that COVID-19 and any other viruses or other diseases which may be spreading in the area at the time of my participation in the Activities are public health risks, and the Companies c annot guarantee my safety or immunity from infection. There is no known va ccination for COVID-19 and there may be none for other viruses or other diseases to which I may be exposed at the Companies. With full appreciation of these fa cts, I voluntarily agree to participate in the Activities. In consideration for my participation, I knowingly and voluntarily assume all risks associated with my participation in the Activities, including but not limited to, the risk of illness, death, bodily injury, disability, or exposure or infection with COVID-19 or other viruses or diseases which may be spreading in the area at the time of my participation in the Activities. 8. I FULLY UNDERSTAND that: (a) THE ACTIVITIES ARE VERY DANGEROUS and participation in these Activities and/ or entry into Restricted Areas involves RISKS AND DANGERS OF SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS AND DEATH, injury to third parties, and damage to property (“Risks”); (b) these Risks and dangers may be c aused by my own a ctions, or ina ctions, the a ctions or ina ctions of others participating in the Activities, the condition and layout of the Companies, premises and equipment, or THE NEGLIGENCE OF THE “RELEASEES” NAMED BELOW; ( c) there may be OTHER RISKS NOT KNOWN TO ME or that are not readily foreseeable at this time. I ACKNOWLEDGE THAT I (OR MY MINOR CHILD) AM IN GOOD HEALTH, HAVE NO PHYSICAL OR MENTAL LIMITATIONS THAT WOULD PRECLUDE MY (OR MY MINOR CHILD’S) SAFE PARTICIPATION IN THE ACTIVITIES. While onboard the vessel, continue to practice good hygiene and avoid contact with persons who have been diagnosed with the active COVID or other viruses. Note that any illness during cruise will decrease your experience, pose a risk of infection to others, and may require you to remain aboard during port-calls. Severe illnesses may require you to return home from cruise for treatment.
AND OTHER COMMUNICABLE DISEASES. Licensee acknowledges and expressly assumes all risks that are in any way related to or arising from being exposed to or contracting COVID-19 or other Communicable Disease in the Venue. By using this ticket, Licensee is acknowledging and confirming, both now and in the future, that Licensee understands and expressly assumes the risk that Licensee and any Accompanying Party may be exposed to COVID-19 or other Communicable Disease. Licensee expressly understands that these risks include contracting COVID-19 or other Communicable Disease and the associated dangers, medical complications and physical and mental injuries, both foreseen and unforeseen, that may result from contracting COVID-19 or other Communicable Disease. Licensee further acknowledges and understands that any interaction with the general public poses an elevated, inherent risk of being exposed to and contracting Communicable Disease, including, but not limited to, COVID-19, that it cannot be guaranteed that Licensee or any Accompanying Party will not be exposed, and that as such, potential exposure to or contraction of COVID-19 or other Communicable Disease are risks inherent in Licensee’s decision to use this ticket that cannot be eliminated.

  • Notices and Other Communications Any and all notices, statements, demands or other communications hereunder may be given by a party to the other by mail, facsimile, telegraph, messenger or otherwise to the address specified in Annex II hereto, or so sent to such party at any other place specified in a notice of change of address hereafter received by the other. All notices, demands and requests hereunder may be made orally, to be confirmed promptly in writing, or by other communication as specified in the preceding sentence.

  • PAYMENTS, NOTICES AND OTHER COMMUNICATIONS Any payment, notice or other communication pursuant to this Agreement shall be sufficiently made or given on the date of mailing if sent to such party by certified first class mail, postage prepaid, addressed to it at its address below or as it shall designate by written notice given to the other party:

  • Notices and other communication Any notice to be given under this Consortium Agreement shall be in writing to the addresses and recipients as listed in the most current address list kept by the Coordinator. Notices and other communications sent by hand or overnight courier service, or mailed by certified or registered mail, shall be deemed to have been given when received; notices and other communications sent by telecopier shall be deemed to have been given when sent (except that, if not given during normal business hours for the recipient, shall be deemed to have been given at the opening of business on the next business day for the recipient). Notices and other communications delivered through electronic communications to the extent provided in Section 10.02(b) shall be effective as provided in such Section 10.02(b).

  • Executive and Other Committees The Trustees by vote of a majority of all the Trustees may elect from their own number an Executive Committee to consist of not less than two members to hold office at the pleasure of the Trustees, which shall have the power to conduct the current and ordinary business of the Trust while the Trustees are not in session, including the purchase and sale of securities and the designation of securities to be delivered upon redemption of Shares of the Trust or a Series thereof, and such other powers of the Trustees as the Trustees may delegate to them, from time to time, except those powers which by law, the Declaration of Trust or these By-Laws they are prohibited from delegating. The Trustees may also elect from their own number other Committees from time to time; the number composing such Committees, the powers conferred upon the same (subject to the same limitations as with respect to the Executive Committee) and the term of membership on such Committees to be determined by the Trustees. The Trustees may designate a Chairman of any such Committee. In the absence of such designation the Committee may elect its own Chairman.

  • Returns and Other Elections The Managers shall cause the preparation and timely filing of all tax returns required to be filed by the Company pursuant to the Code and all other tax returns deemed necessary and required in each jurisdiction in which the Company does business. All elections permitted to be made by the Company under federal or state laws shall be made by the Managers with the consent of the Member(s).

  • Contracts and Other Commitments The Company does not have and is not bound by any contract, agreement, lease, commitment, or proposed transaction, judgment, order, writ or decree, written or oral, absolute or contingent, other than (i) contracts for the purchase of supplies and services that were entered into in the ordinary course of business and that do not involve more than $100,000 and do not extend for more than one year beyond the date hereof, (ii) sales contracts entered into in the ordinary course of business, and (iii) contracts terminable at will by the Company on no more than thirty (30) days’ notice without cost or liability to the Company and that do not involve any employment or consulting arrangement and are not material to the conduct of the Company’s business. For the purpose of this paragraph, employment and consulting contracts and contracts with labor unions, and license agreements and any other agreements relating to the Company’s acquisition or disposition of patent, copyright, trade secret or other proprietary rights or technology (other than standard end-user license agreements) shall not be considered to be contracts entered into in the ordinary course of business.

  • Special, Indirect and Other Losses EXCEPT (A) IN THE EVENT OF THE WILLFUL MISCONDUCT OR FRAUD OF A PARTY OR OF A PARTY’S BREACH OF ITS OBLIGATIONS UNDER ARTICLE 9 OR SECTION 4.5, (B) AS PROVIDED UNDER SECTION 13.10, AND (C) TO THE EXTENT ANY SUCH DAMAGES ARE REQUIRED TO BE PAID TO A THIRD PARTY AS PART OF A CLAIM FOR WHICH A PARTY PROVIDES INDEMNIFICATION UNDER THIS ARTICLE 11, NEITHER PARTY NOR ANY OF ITS AFFILIATES OR (SUB)LICENSEES SHALL BE LIABLE IN CONTRACT, TORT, NEGLIGENCE, BREACH OF STATUTORY DUTY OR OTHERWISE FOR ANY SPECIAL OR PUNITIVE DAMAGES OR FOR LOSS OF PROFITS SUFFERED BY THE OTHER PARTY IN CONNECTION WITH THIS AGREEMENT IRRESPECTIVE OF WHETHER THAT PARTY OR ANY REPRESENTATIVE OF THAT PARTY HAS BEEN ADVISED OF, OR OTHERWISE MIGHT HAVE ANTICIPATED THE POSSIBILITY OF, ANY SUCH LOSS OR DAMAGE.
