Application of Tariffs. Level 3 may elect or be required to file with the ----------------------- appropriate regulatory agency tariffs respecting the delivery of certain Service. In the event that such tariffs are filed respecting Service ordered by Customer, then (to the extent such provisions are not inconsistent with the terms of a Customer Order) the terms set forth in the applicable tariff shall govern Level 3's delivery of, and Customer's consumption or use of, such Service.

Application of Tariffs. American Assistance may elect or be required to file with the appropriate regulatory agency tariffs regarding the delivery of certain Services. In the event that such tariffs are filed with respect to any of the Services ordered by you, the terms set forth in the applicable tariff (or any successor document in the event of detariffing) shall govern delivery of, and your use of, the Services subject to the tariff. Such tariffs are hereby incorporated by reference.

Application of Tariffs. CyrusOne may elect or be required to file with the appropriate regulatory agency tariffs respecting the delivery of certain Service. In the event that such tariffs are filed respecting Service ordered by Customer, then (to the extent such provisions are not inconsistent with the terms of a Customer Order Form) the terms set forth in the applicable tariff shall govern CyrusOne’s delivery of, and Customer’s consumption or use of, such Service.

Application of Tariffs. DYOPATH may elect or be required to file with the appropriate regulatory agency tariffs respecting the delivery of certain Service. In the event that such tariffs are filed respecting Service ordered by Client, then (to the extent such provisions are not inconsistent with the terms of an Attachment A) the terms set forth in the applicable tariff shall govern DYOPATH’s delivery of, and Client’s consumption or use of, such Service.

Application of Tariffs. Interstate Adjustment. Intrastate Service will be provided pursuant to tariff where required. In such event, an interstate adjustment may be applied based on intrastate usage, which shall be subject to further definition in accordance with Section 23. The interstate adjustment for a given month shall not exceed interstate billing for such month.

Application of Tariffs. 4.1 This agreement is intended to supplement the applicable Tariffs in effect covering the Services. The relationship of the Parties shall be subject to the applicable Tariffs; in the event that there is an inconsistency between the rates specifically provided in this Agreement and the rates provided in the Company Tariffs, the rates, terms and conditions of this Agreement shall control. Any modification to the Tariffs after this Agreement is executed shall be controlling over this Agreement, provided, however, that MetTel shall provide notice to Customer of proposed changes to applicable tariffs and in the event that the effect of such tariffs is to materially alter the service to be provided by MetTel hereunder or change any material rate or term hereof, then either party shall have the right to terminate this agreement.

Application of Tariffs. In the event Supplier is required to file tariffs with a Governmental Authority, the terms set forth in the applicable tariff shall govern Supplier’s delivery of, and Customer’s consumption or use of, such Services to the extent required by law, rule or regulation. In the event that any change to the terms and conditions and/or the Service Fees results from such application of tariffs to the Services and such change has a materially adverse effect on Customer, then Customer shall have a right to terminate the affected Services upon thirty (30) days written notice (such notice to be given within thirty (30) days after notice of such tariff or effect is provided to Customer by Supplier or is posted on Supplier’s website), unless within such period, Supplier files tariff changes or takes other steps that prevent such material adverse effect.

Application of Tariffs. Banks Data/Com may elect or be required to file with the appropriate regulatory agency tariffs respecting the delivery of certain services by Banks Data/Com to Customer. In the event that such tariffs are filed respecting services ordered by Customer, then the terms set forth in the applicable tariff shall govern Banks Data/Com’s delivery of, and Customer’s consumption or use of, such services.

Application of Tariffs. In the event Cybernet is required to file tariffs with a Governmental Authority, the terms set forth in the applicable tariff shall govern Cybernet's delivery of, and Customer's consumption or use of, such Services but only to the extent required by law, rule or regulation. In the event that there is any material change required to the Terms of Service and / or the Service Fees then Customer shall have a right to terminate the affected Services.
