If unemployment within the District of the applicant’s home address exceeds eight per- cent (8%) or ten (10) Journeymen and Apprentices, whichever is greater, the Employer may start not hire a new apprentices providing Apprentice for thirty (30) days after the ratio JATC notifies the Union of apprentices to journeyman the request for an Apprentice, or until the percent no longer exceeds eight percent (8%) or ten (10) Jour- neymen and Apprentices within the District of the applicant’s home address. Within fifteen (15) calendar days of hiring a new Apprentice, any layoff by the Employer within one hundred (100) miles of that Apprentice’s home address shall include the new Ap- prentice. If the newly employed Apprentice is terminated by the Employer for just cause or quits, the Employer may replace that Apprentice. The just cause requirement shall not apply to probationary Apprentices. Newly indentured Apprentices shall be issued a temporary ID before they report for work. The temporary ID shall be e-mailed or faxed to the hiring contractor within 24 hours of JATC’s approval. This temporary ID will be valid up to 120 days from date of hire. The temporary ID shall be sent by fax, e-mail, or other such rapid means to the Contractor to permit immediate placement on the payroll. All Apprentices shall be paid a progressively increasing rate of wage based upon the ap- plicable percentage schedules in effect. It is understood and indenture new apprenticesagreed that adoption of the foregoing Apprentice wage structure shall not result in a decrease in the wage rate of any existing Apprentice. Apprentices. 21:01 There 55.01 The terms and conditions for the engagement of Employees as apprentices are agreed as follows: (a) The Apprenticeship, Trade and Occupations Certification Act and pursuant regulations shall apply to all apprentices. Each Apprentice must attend a minimum of 216 (two hundred sixteen) classroom hours of related training per year at times designated by the JATC provided such times are not between the hours of 8:00 A.M. to 4:30 P.M., Monday through Friday. Apprentices. 21:01 There shall be SECTION 1. It is mutually agreed that a Joint Apprenticeship Committee consisting Trust Fund has been established. (c) Pay increases shall not be automatic but will be based upon levels of certification issued by the Apprentices Branch and shall be effective from the date of certification. (i) a top up to one hundred percent (100%) of housing costs, after applying funding available to the Apprentice from all other sources for the purpose of accommodations, the Employer will pay directly to the accredited organization after being invoice by the accredited organization for the housing costs. Where the Employer contributes to accommodation, they will be entitled to make the necessary arrangements. (ii) telephone calls for the purpose of arranging accommodations beforehand and for calling the Employee's headquarters while on course. Apprentices. 21:01 There shall be a Joint Apprenticeship and Training Committee consisting of three (3) members designated by The Greater New York and New Jersey Tile Contractors Association, Inc. and (1) member of the Building Contractors Association of Atlantic County and three (3) members designated by the Union to administer the Apprenticeship Training Program shall meet at least semi-annually. An apprentice shall be defined as a "Local 7 Apprentice" in the Apprenticeship Training Program. The Apprenticeship Training Program shall be a four (4) year program for all Local 7 Tile Setters. The program for the Tile Finisher apprentices shall be a three (3) year program. The Apprenticeship Training Program shall provide for mandatory cross-training and upgrading for all Local 7 apprentices. Apprentices. 21:01 There 5.1 The Employer and BACU mutually agree that, in the best interests of the Industry, Apprentices ought to be hired and properly trained, and further agree that a provincial training trust fund shall be established immediately. 5.2 Indentured Apprentices must be registered with the Industrial Training Branch, Ministry of Colleges and Universities. 5.3 The minimum rate for Apprentices and Improvers shall be: 50% of a Journeyman's rate for the first period 65% of a Journeyman's rate for the second period 80% of a Journeyman's rate for the third period 90% of a Journeyman's rate for the fourth period. Apprentices. 21:01 There A Council known as the Joint Apprenticeship and Training Council shall be formed and all apprentices shall be subject to the rules and conditions of the Council. The Employer further agrees to fill out verifications of Trade Experience and give them to the Apprentice upon termination. 21:05 Preference of employment shall be granted to all indentured Apprentices in order to provide a reasonable opportunity for those indentured to complete their apprenticeship. 21:06 In all cases the ratio of apprentices to journeymen shall not exceed the ratio established by the Saskatchewan Apprenticeship and Trade Certification Commission. Apprentices. 21:01 (a) Apprentice rates to be returned to the Apprenticeship Act scale. There shall will be a Joint Apprenticeship Committee consisting of two (2) members representing the Employers and two (2) members representing the Union. This committee shall establish standards governing the selection, qualifications, education and training of all Apprentices and/or training of Journeymen and others. 21:02 Members of the Joint Apprenticeship Committee shall be selected by the Party they represent. Their term of office shall be three (3) years and any member shall month or twelve (12) week probation period for new apprentices. (b) No pension contributions for the first two thousand hours (2,000) hours worked. (c) It is agreed that there will be subject to removal a three (3) year Apprenticeship Program for cause by Commercial Residential Apprentices. Apprentices. 21:01 There shall be a Joint Local 7 Apprenticeship and Training Committee (JATC) consisting of one (1) member designated from each craft Association and one (1) member designated by the Union to administer the Apprenticeship Training Program which shall meet at least semi-annually. There shall be an Apprentice program maintained by the parties in conformity with federal and state Department of Labor approved standards. The Apprentice program shall run for four (4) years. This Committee shall be empowered to enforce all rules and regulations concerning apprentices. The rules and regulations governing the working of Local 7 Apprentices shall be as follows: (1) All Employers desiring to hire an apprentice shall apply to the JATC. (2) The JATC shall assign all apprentices to the Employers. There shall be a 1-4 ratio on all jobs or revert to Project Labor Agreement (PLA) requirements. (3) If an Employer has four (4) or more Journeymen, the Employer may not lay off an apprentice, without approval from the JATC. If the Employer has less than four (4) Journeymen, they may lay off an apprentice. However, for the good of everyone, every effort should be made for an Employer to keep and train an apprentice as long as possible. (4) If an Employer is not able to keep an apprentice in its employ, the employer must notify the JATC at least two (2) members representing weeks before they wish to terminate the Employers employment, so that the Committee may have the opportunity to try and two place the apprentice with another Employer. (25) members representing The Employer must give the apprentice training on every type of terrazzo work and not have him perform the same type of work consistently merely because the apprentice is proficient at it. If any Employer does not give the apprentice broad and comprehensive training, the JATC may remove the apprentice from the Employer and assign the Apprentice elsewhere. (6) The apprentice will file a monthly report with the JATC Coordinator of Local No. 7 stating what types of terrazzo work the apprentice has performed for the past month and how much time the apprentice spent on each type of terrazzo work performed. (7) An apprentice may only work for the Employer to which the JATC assigns them. (8) The JATC shall have the final say as to whom and to which Employer the apprentice shall be assigned. (9) Any disputes or deadlock that may arise in the JATC shall be settled by arbitration in accordance with Article XVI of this Agreement. The Parties agree that the selection of apprentices shall be made without regard to race, color, creed, sex, age, religious beliefs, handicap, marital status, sexual orientation or affection preference, or national origin in accordance with all applicable state and federal laws governing apprenticeship training. The following is the schedule of wages as expressed in percentages of the prevailing rate of Journeymen's pay which shall be paid to the nearest nickel.
