Arbitrator Selection - If the grievance is not settled at Step 3, and the Medical Center’s 15 final answer is not satisfactory to the Association, the Association may refer the grievance to 16 binding arbitration through written notice to the Medical Center within fourteen (14) calendar 17 days of the answer of the Medical Center’s Chief Executive given at Step 3. The Association 18 and the Medical Center shall thereafter attempt to select an arbitrator. If the parties cannot 19 agree upon an arbitrator within a period of fourteen (14) calendar days, either party may then 20 request a list of seven arbitrators from the Federal Mediation and Conciliation Service. The 21 parties shall thereafter alternately strike one name from the list, and the last name remaining 22 shall be the arbitrator selected to hear the dispute; provided that, if either party objects to the list 23 provided by the Federal Mediation and Conciliation Service, it shall have the right to reject the 24 list and to request a new list. The arbitrator must be selected from the second list in accordance 25 with the foregoing procedure. The arbitrator shall be notified of his selection by a joint letter 26 from the Medical Center and the Association requesting that he set a time and place for the 27 hearing, subject to the availability of Medical Center and Association representatives. 28

  • Arbitrator Selection The arbitrator will be appointed by the Administrator in accordance with the rules of the Administrator. However, unless the parties agree otherwise, the arbitrator must be a retired or former judge or a lawyer with at least ten (10) years of experience.

  • Union Grievance Committee (a) The Employer shall recognize a Union Grievance Committee which consists of:

  • Disciplinary Grievance If a grievance alleging that a disciplinary action (reduction in base pay, demotion, involuntary transfer of more than 50 miles by highway, suspension, or dismissal) was taken without cause is not resolved at Step 2, the PBA may appeal the grievance to arbitration within 15 days after receipt of the decision at Step 2, provided the Step 2 decision is received on or before the due date.

The determination letter will provide you with the rationale for our response as well as information on any possible next steps available to you. When filing a complaint, please provide the following information: • your name, address, member ID number; • the date of the incident or service; • summary of the issue; • any previous contact with BCBSRI concerning the issue; • a brief description of the relief or solution you are seeking; and • additional information such as referral forms, claims, or any other documentation that you would like us to review.   • Policy Grievance – Union Grievance The Union may institute a grievance alleging a general misinterpretation or violation of this Agreement by the Employer by submitting a written grievance at Step No. 1 within twenty (20) days after the circumstances have occurred. This section shall not apply to disciplinary grievances or application of competitive clauses under this Agreement.

  • Contractor Selection In this section, please describe the selection process, including other sources considered and the rationale for selecting the contractor. Please answer all questions:

  • Panel Listing and number of Members that Network Providers have agreed to provide services for in accordance with this Contract.

  • Class Grievance Class grievances involving one or more employees or one or more supervisors, and grievances involving an administrator above the building level may be initially filed by the Association at Step II.

  • Grievance Procedure - Individual In the case of a grievance by the Bargaining Unit on behalf of one of its Members, the following steps may be taken in sequence where informal attempts to resolve the matter with the immediate supervisor have failed.

  • Grievance Committee The Hospital will recognize a Grievance Committee composed of the Chief Xxxxxxx and not more than (as set out in Local Provisions Appendix) employees selected by the Union who have completed their probationary period. A general representative of the Union may be present at any meeting of the Committee. The purpose of the Committee is to deal with complaints or grievances as set out in this Collective Agreement. The Union shall keep the Hospital notified in writing of the names of the members of the Grievance Committee appointed or selected under this Article as well as the effective date of their respective appointments. A Committee member shall suffer no loss of earnings for time spent during their regular scheduled working hours in attending grievance meetings with the Hospital up to, but not including arbitration. The number of employees on the Grievance Committee shall be determined locally.
