As-Built Surveys Clause Samples
As-Built Surveys. Administrative Agent shall have received a composite, as-built ALTA survey (or, in Administrative Agent’s reasonable discretion, an aerial survey) of the Sites (but excluding the Border Parcels if an ALTA survey is delivered) and showing the Projects as completed, except for WTGs in an aggregate amount for all of the Projects not to exceed nineteen (19) WTGs, in form and substance reasonably satisfactory to Administrative Agent and the Title Insurer, prepared not more than sixty (60) days prior to Term-Conversion and certified to Administrative Agent by a licensed surveyor reasonably satisfactory to Administrative Agent, showing (i) as to the Sites, the exact location and dimensions thereof, including the location of all means of access thereto and all easements relating thereto and showing the perimeter within which all improvements are located and all encroachments thereon; (ii) the location and dimensions of all transmission lines, WTGs (other than WTGs in an aggregate amount for all of the Projects not to exceed nineteen (19)), Improvements, fences or encroachments located in or on the Sites; (iii) that the location of each Project and the location of WTGs (other than WTGs in an aggregate amount for all of the Projects not to exceed nineteen (19)) and other Improvements are in compliance with all applicable setback laws and do not encroach on or interfere with adjacent property or existing easements or other rights (except to the extent any encroachments are insured over by the Title Policies); (iv) that the Real Property for each Site is contiguous and the transmission lines are contiguous without break, gap or interruption; (v) whether the Sites or any portion thereof are located in a special earthquake or flood hazard zone; and (vii) that there are no other visible encroachments or easements other than Permitted Liens; provided, however, that if the as built survey is an aerial survey, it may not satisfy the standards for accuracy of an ALTA survey with respect to precision of measurement.
As-Built Surveys. The Borrower shall deliver to the Administrative Agent, the Institutions, the Independent Engineer and the Title Company, no later than 180 days after the date on which Final Completion with respect to the Facility shall have occurred, a copy of an "as built" survey of the Site (other than the Leased Land) and the Easements, showing the location of the Facility within the boundaries of the Site (other than the Leased Land), prepared by a licensed surveyor reasonably acceptable to the Administrative Agent and Majority Institutions, certified to the Administrative Agent, the Institutions and the Title Company pursuant to a surveyor's certification reasonably satisfactory to them and showing no state of facts unsatisfactory to the Title Company. The Borrower shall also deliver to the Administrative Agent and the Institutions, promptly following its receipt thereof, a copy of the "as built" survey of the Leased Land delivered to the Borrower pursuant to the Greenhouse Loan Agreement, certified by a licensed surveyor reasonably acceptable to the Administrative Agent and the Majority Institutions and showing the location of the Greenhouse to be within the boundaries of the Leased Land, which shall be reasonably satisfactory in form and substance to the Administrative Agent and the Majority Institutions.
As-Built Surveys. Within thirty (30) after the completion of construction of each Digester, the Company, at the Company’s sole cost and expense, shall deliver to the Agent a final “as-built” survey of such Digester, certified to the Agent and the relevant title insurance company, showing the completed Digester, which survey shall be in form and substance satisfactory to the Agent and the title insurance company, and shall disclose no easements, rights-of-way or other encumbrances, except for those that are acceptable to the Agent.
As-Built Surveys. Developer shall furnish to City, at City's option, immediately upon completion of the foundation and immediately upon completion of the Improvements, respectively, a survey, or other evidence satisfactory to City, showing that said foundation and Improvements, respectively, are located entirely within the Property lines, and do not encroach upon any easement or public or private right of way, or breach or violate any covenant, condition or restriction of record, or any building or zoning ordinance.
As-Built Surveys. A survey of each of the Properties (the “As-built Survey”) prepared by a licensed surveyor or civil engineer in sufficient detail to provide for the Title Policies, certified to Buyer and Title Company conforming to the minimum requirements for ALTA/ACSM land title surveys set forth on Exhibit “D,” attached hereto and made a part hereof, to be delivered to Buyer. If no written disapproval of the As-built Survey is received from Buyer on or before ten (10) days after the later of delivery of the As-built Survey or the respective Commitment, the As-built Survey shall be deemed approved by Buyer. Notwithstanding the foregoing, ▇▇▇▇▇ will accept current As-built Survey’s in Seller’s possession provided: (i) Title Company is willing to accept from Seller “A Survey Affidavit in lieu of Updated Survey” (“Survey Affidavit”) and; (ii) Title Company is willing to provide survey coverage to Buyer upon receipt of the Survey Affidavit from Seller.
As-Built Surveys. At Lender's request during construction, Borrower shall submit as-built surveys for the site improvements on the Property to Lender and shall reference the as-built survey in the title insurance policy. In addition, during construction, Lender may request certification from Borrower that all on-site and off-site Improvements required to be constructed have been completed strictly in accordance with the approved Plans and Specifications. The surveys shall show and include the requirements expressed in the Commitment and such other requirements as Lender may require. All surveys shall be sealed and certified to Lender and the title insuror.

A survey of each of the Properties (“As-built Survey”) prepared by a licensed surveyor or civil engineer in sufficient detail to provide for the Title Policies, certified to Buyer and Title Company conforming to the minimum requirements for ALTA/ACSM land title surveys set forth on Exhibit “D,” attached hereto and made a part hereof, to be delivered to Buyer. If no written disapproval of the As-built Survey for a particular Property is received from Buyer on or before ten (10) days after the later of delivery of the As-built Survey or the respective Commitment, the As-built Survey shall be deemed approved by Buyer.
As-Built Surveys. The borrow area; pump-out area(s); conveyance corridor(s) including roadway, and channel locations where applicable; beach and dune fill area; sand fencing; and settlement plates shall be surveyed by the Contractor after construction is complete. Final payment will not be made until the As-Built Survey and Work have been accepted by the Engineer.
