Asset Sharing. The NJNG may submit sharing requests to the LEA with respect to assets seized during operations in which the NJNG participated. All sharing requests will be processed in accordance with applicable LEA statutory and regulatory guidance. Final decision-making authority on all sharing requests resides in the appropriate LEA official.

Asset Sharing. Task force operations, which result in the potential for either State or Federal asset seizures, shall be brought to the attention of the Executive Committee. The Committee will assess whether an application for asset forfeiture sharing will be made pursuant to appropriate State or Federal law. Any forfeited funds paid to the task force shall be retained by the task force to pay for operational expenses.
Asset Sharing. 1. One Party may make a request for asset sharing when its assistance in accordance with the provisions of this Agreement has materially led, or is expected to lead, to confiscation. 2. Subject to each Party’s domestic laws, the Requested Party shall assist in the proceedings before the relevant authorities in the determination of the proportion of the assets to be shared in accordance with the extent of the assistance afforded by the Requesting Party, unless the value of the realized assets or the assistance rendered by the Requesting Party is de minimis. 3. In appropriate cases where there are identifiable victims, consideration of the rights of victims may take precedence over asset sharing between the Parties. The rights claimed by bona fide third parties over these assets shall be respected as well.
Asset Sharing. During the course of enforcement and investigative activities by the MCTF, HSI Omaha will attempt to identify and seize assets that may be forfeited under federal, state and local administrative, civil, and criminal forfeiture statutes. Such activities will be executed in accordance with federal laws and regulations, and agency and prosecutorial policies and guidelines.

Vessels, aircraft and other assets seized in consequence of any operation undertaken within Barbados or United States waters or airspace pursuant to this Agreement shall be disposed of in accordance with the laws of that Party. 2. Vessels, aircraft and other assets seized in consequence of any operation undertaken seaward of the territorial sea of any State pursuant to this Agreement shall be disposed of in accordance with the laws of the seizing Party. 3. To the extent permitted by its laws and upon such terms as it deems appropriate, the seizing Party may in any case, transfer forfeited vessels, aircraft or other assets or proceeds of a sale thereof, to the other Party.
Asset Sharing. The Contracting Parties may, consistent with this Agreement and with other agreements between them pertaining to the sharing and disposition of forfeited assets, share seized and forfeited assets if the assistance provided under this Agreement substantially contributed to the seizure and forfeiture, of those assets, where in accordance with domestic laws and regulations of the Contracting party executing the seizure and forfeiture. The determination as to whether and how to share those assets shall be at the discretion of the Contracting Party seizing and forfeiting the assets.
Asset Sharing. During its enforcement and investigative activities, the San Antonio BEST will attempt to identify and seize assets that may be forfeited under state and federal civil and criminal forfeiture statutes. In accordance with law, federal regulations, and the provisions of the Treasury Executive Office of Asset Forfeiture (TEOAF), which oversees the Treasury Forfeiture Fund, up to 80% of property federally forfeited is eligible to be distributed to state or local agencies participating in the seizure and investigation. Where allowable by regulations and law, each state or local member agency will receive an equitable portion of those assets based on their contribution to the investigation or seizure by the San Antonio BEST. In accordance with TEOAF guidelines, federal agencies participating in the San Antonio BEST may share in forfeited assets based upon their contribution to the investigation or seizure by the San Antonio BEST. HSI will recommend to TEOAF that such participating agencies receive their equitable share.

  • JOB SHARING North Bay; Perth-Huron; Peterborough, Victoria & Haliburton; Sarnia- Lambton Taking into consideration the fact that the Employer wishes to retain well- qualified staff who are unable or prefer not to provide a full-time commitment and the job-sharing can enable this to happen, the parties agree to the following provisions: (a) Job-sharing requests with regard to full-time positions shall be considered on an individual basis, and the Employer shall reserve the right to determine the appropriateness of such arrangements, including the number of job-shared positions after discussions with the Union at the Labour Management Committee. (b) Any incumbent full-time Nurse wishing to share their position may do so without having their half (½) of the position posted. The other half (½) of the job-sharing position will be posted, and selection will be in accordance with the Collective Agreement. (c) Save and except as provided for herein, all job-sharers shall be treated as part-time employees and shall receive percentage in lieu of benefits. (d) If one (1) of the job-sharers leaves the arrangement, their position will be posted. If there is no successful applicant to the position, the shared position must revert to a full-time position. The remaining Nurse will have the option of continuing the full-time position or reverting to a part-time position for which they are qualified. If they do not continue full-time, the position must be posted in accordance with the Collective Agreement. (e) Posted schedules for the job-sharers shall be based on the schedules that would apply to a full-time Nurse holding that position. Such schedule shall conform to the scheduling provisions for full- time. (f) Total hours worked by the two job-sharers shall be equal to one full- time position. The division of these hours over the schedule shall be determined by mutual agreement between the two Nurses and the immediate Supervisor. This does not exclude the Nurses from opportunities for extra available work. (g) Each job-sharer may exchange shifts with their partner, as well as with other Nurses in accordance with the Collective Agreement, provided such exchange creates no additional labour cost to the Employer and meets continuity requirements. (h) It is expected that both job-sharers will cover each other’s absences including incidental illnesses and vacation. If, because of unavoidable circumstances, one cannot cover the other, the Supervisor must be notified to book coverage. Job-sharers are not required to cover for their partners in the case or prolonged or extended absences but may be offered the opportunity to do so. (i) Job-sharers will not be required to work in total more paid holidays than would one full-time Nurse, unless mutually agreed otherwise. Job-sharers will have the right to determine which partner works the scheduled holidays.   • Leave Sharing Consistent with RCW 28A.400.380 and WAC 392-126, a leave sharing program is established as follows: A. A district employee is eligible to receive donated leave if: 1. The staff member suffers from, or has a relative or household member suffering from, an extraordinary or severe illness, injury, impairment, or physical or mental condition which as caused, or is likely to cause, the staff member to: a. Go on leave without pay status; or b. Terminate his/her employment; 2. The staff member’s absence and the use of shared leave are justified; 3. The staff member has depleted, or will shortly deplete, his/her annual leave and sick leave reserves; 4. The staff member has abided by district rules regarding sick leave use; and 5. The staff member has diligently pursued and been found to be ineligible to receive industrial insurance benefits. Any employee who wishes to receive leave under this provision shall submit a request in writing to the personnel office. The employee shall submit, prior to leave sharing approval, documentation from a licensed physician or other authorized health care practitioner verifying the severe or extraordinary nature and expected duration of the condition. Employees meeting the criteria indicated above shall be eligible for leave sharing. A staff member shall not receive more leave than the number of normal work days remaining in the current school year. In the event that the condition requiring the employee’s absence continues beyond the current school year, the employee shall not receive a total of more than 261 days of leave. B. District employees may donate leave as follows: 1. An employee who does not earn annual leave (vacation) and who has an accrued sick leave balance of more than sixty (60) days may request that the superintendent or designee transfer a specified amount of sick leave to another staff member authorized to receive such leave. A staff member may request to transfer no more than six (6) days of sick leave during any twelve (12) month period, and may not request a transfer that would result in an accrued sick leave balance of fewer than sixty (60) days. Employees who accrue vacation must transfer vacation days prior to sick leave days. Sick leave as defined in RCW 28A.58.099 (28A.400.300) means leaves for illness, injury, and emergencies. The number of leave days transferred shall not exceed the amount authorized by the donating staff member. 2. The value of any leave transferred under this policy which remains unused shall be returned to its original value to the staff member who donated the leave. To the extent administratively feasible, the value of unused leave which was transferred by more than one staff member shall be returned on a pro-rata value basis.

  • Sharing If any Lender shall obtain payment of any principal of or interest on any Loan owing to it or payment of any other amount under this Agreement or any other Loan Document through the exercise (subject to the provisions of Section 14.10) of any right of set-off, banker’s lien or counterclaim or similar right or otherwise (other than from the Administrative Agent as provided herein), and, as a result of such payment, such Lender shall have received a greater percentage of the principal of or interest on the Loans or such other amounts then due hereunder or thereunder by the Borrower to such Lender than the percentage received by any other Lender, it shall promptly purchase from such other Lenders participations in (or, if and to the extent specified by such Lender, direct interests in) the Loans or such other amounts, respectively, owing to such other Lenders (or in interest due thereon, as the case may be) in such amounts, and make such other adjustments from time to time as shall be equitable, to the end that all the Lenders shall share the benefit of such excess payment (net of any expenses that may be incurred by such Lender in obtaining or preserving such excess payment) pro rata in accordance with the unpaid principal of and/or interest on the Loans or such other amounts, respectively, owing to each of the Lenders. To such end all the Lenders shall make appropriate adjustments among themselves (by the resale of participations sold or otherwise) if such payment is rescinded or must otherwise be restored. Each Lender agrees that it shall turn over to the Administrative Agent (for distribution by the Administrative Agent to the other Lenders in accordance with the terms of this Agreement) any payment (whether voluntary or involuntary, through the exercise of any right of setoff or otherwise) on account of the Loans held by it in excess of its ratable portion of payments on account of the Loans obtained by all the Lenders.

Where it is approved and confirmed by Party A in writing, it shall not be later than June 15, 2021.
