ASSOCIATION RIGHTS 1. There will be no reprisals taken against any member by reason of his/her membership in the Association. 2. The Association may use facilities of any building for meetings and Association business, without fee, upon notification and approval of the administrator in charge of such buildings. 3. The Association may use Board-owned equipment on school property including calculators, computers, printers and copiers, public address equipment and audio- visual equipment at times which do not interfere with the operation of the school system. Any expendable supplies (paper) will be supplied by the Association. Any loss or willful damage of Board-owned equipment while in use for Association business shall be the responsibility of the Association to repair or replace (if lost). The Association President shall be solely responsible for written designation and authorization of Board-owned equipment on behalf of the Association. 4. The Association may use the inter-school mail and email systems in the schools’ offices to distribute Association bulletins, newsletters, or other communications. The Superintendent shall receive a copy of these communications at the time of distribution. All computer and email use shall be consistent with the Board’s acceptable use policy. 5. The Association may use a designated bulletin board(s) in each building for dissemination of information to members. The bulletin board(s) designated shall be agreed upon between the Association and the building principal annually by September 15. 6. Representatives of the Association may visit schools with notification to the building administrator or her/his designee. 7. Representatives of the Association may transact Association business on school property insofar as it does not interfere with the operation of the school system. 8. The Association shall have the use of office space in one (1) of the school buildings. The Association and the Superintendent shall agree on the location by May 15 for the following school year. 9. One (1) Association member shall be appointed by the Association to be involved in the interviewing of finalists for administrative positions other than the Treasurer. 10. The Association shall be granted fourteen (14) days’ leave with pay for its members to perform professional duties directly related to local Association business that cannot be performed at times other than on regular school days. 11. The Association shall be provided with: a. A copy of all Board agendas, approved minutes, financial reports, appropriations, budgets, training and experience grids, or any other routinely prepared report or financial document. Such copies shall be available for the President of the Association at the Superintendent’s office as soon as they are made available to the Board. b. A place on the agenda of all regular Board meetings to be used by the Association to communicate with the Board; and c. A place at the end of the agenda of all members’ meetings whether system-wide or within buildings upon notification to the administrator calling the meeting.
ASSOCIATION RIGHTS AND PRIVILEGES A. There will be no reprisals of any kind taken against any teacher solely by reason of his/her membership in the Association or for participation in any of its lawful activities. B. The Association will be provided with copies of minutes of public session official Board meetings. The Board will be provided copies of minutes of public session meetings of the Association. C. The Association may request and shall be given a place on the agenda of all regular Board meetings for brief reports and announcements. D. The Superintendent shall be available upon reasonable request to meet with representatives of the Association. E. The principal of each school shall be available upon reasonable request of Association representatives to discuss questions relating to the implementation of this Agreement in his/her school. F. The Association will be provided with the names and addresses of all new teachers and all retiring teachers as soon as such information is available. G. The Association will have the right to have placed in the Superintendent’s packet for all new teachers a letter prepared by the Association which informs said teachers that the Association is recognized as the exclusive negotiating representative for all teachers in the Xxxxxx County Public School System. H. The Association shall be given a place on the agenda of the orientation program for new teachers to explain the function and benefits of membership. I. In order for the Association to properly fulfill this Agreement for the benefit of all teachers and the welfare of the school system, the Association representative may visit schools and talk with teachers, provided that the exercise of this right will not interfere with the educational program. The Association representative will check in at the front office of the school upon his/her arrival. J. The Association shall continue to use school buildings without cost at reasonable times for meetings provided the use of the building shall not result in any additional cost to the Board. The principal of the building in question will be notified in advance of the time and place of all such meetings. K. The Association representative will have the right to schedule meetings of the teachers before or after school work days or at any other times which do not disrupt the normal school program. L. There will be bulletin board space of appropriate size reserved for the Association, in an appropriate place in each school building, for the purpose of displaying notices, circulars, and such material. Copies of all such material will be given to the building principal, but his/her advance approval will not be required. M. The Association will have the right to place Association notices, circulars, and other materials in all teachers’ mailboxes. Copies of all such material will be given to the building principal and Superintendent, but his/her advance approval will not be required. The Association will also have the right to use the interschool mail to distribute prepackaged and labeled material, and its office shall be a designated stop on the interschool mail distribution route for delivery of interschool mail, so long as the Association office is on a regular route. N. No teacher will be prevented from wearing pins or other identification of membership in the Association. O. Teachers shall be allowed to attend professional meetings with the approval of the Superintendent. P. The rights and/or privileges granted to the Association in this section will not be granted to any other teachers’ group or organization during the term of this Agreement. Q. Officers and members of the Association recognize that school equipment, time, and materials are intended primarily for the use of pupils. R. Unless a teacher requests that his/her address and phone number not be distributed, the Association faculty representative shall be provided with a faculty list, including home addresses and telephone numbers, by September 15. S. Association officers and/or representatives shall be permitted to draw upon a total of fifty
FEDERATION RIGHTS Section 1. Upon written request, the Employer shall make available one copy of all public information relevant to negotiations or necessary for the proper enforcement of this Agreement, providing such information is readily available and accessible. The Employer may charge reasonable and customary fees for substantial amounts of services. Section 2. The internal business of the Federation shall normally be conducted by employees during their non-duty hours. However, selected and designated Federation officers or appointees shall be allowed a reasonable amount of paid time to investigate and process grievance and arbitration matters. Section 3. The Federation's staff will be allowed to visit work areas during working hours provided that advance permission is received and that the visit shall not unduly disrupt work in progress. Section 4. Whenever members of the bargaining unit are scheduled by the Employer to participate during working hours in conferences or meetings, they shall be granted the necessary release time. Section 5. The Employer shall ensure reasonable access to the Federation an up-to-date policy manual of its rules, regulations, and policies on employment related matters. The Federation shall be notified of any proposed changes or additions to personnel rules, regulations and policies issued by the Department of Administration and the Department of Public Health & Human Services sufficiently in advance to allow discussion and comment by the Federation. Section 6. The Employer, within 30 days of the signing of this Agreement, shall present the Federation with a list of the names and addresses of all current employees covered by this Agreement, and shall update such list each month for all new hires. Section 7. Federation representatives shall have the right to inspect an employee's personnel file with a specific authorization in writing by the employee. Federation representatives may obtain a copy of a document related to a formal grievance provided specific authorization is obtained in writing from the employee. Section 8. The Federation shall have the right to adequate space on bulletin boards for posting notices and shall have access, subject to availability, to a meeting room on the Employer's premises. Section 9. The Employer agrees to provide notice to the Federation of any suspension or discharge of any member of the bargaining unit. Section 10. The Employer agrees to provide 20 working days advance notice to the Federation of any employee layoff, along with an opportunity to comment on the layoff. Section 11. The Employer shall allow a maximum of 18 employees release time for Federation members to attend the MFPE Annual Conference with prior management approval for time off. Section 12. The Federation shall be granted the opportunity to provide membership information to union represented positions during new employee orientation or the onboarding process.
