Base Rent and Operating Expenses. Tenant shall be responsible for the payment of all Base Rent, Operating Expenses and any other obligations due under the Lease through the Termination Date. Tenant shall not be required to pay Base Rent or Operating Expenses for any period following the Termination Date so long as Tenant surrenders the Premises in strict compliance with this Agreement and the Lease, and Tenant is not in breach hereof or under the Lease.
Base Rent and Operating Expenses. 3.1 BASE RENT
Base Rent and Operating Expenses. (a) With respect to the Expansion Premises, Tenant shall continue to pay Base Rent and Tenant's Share of Operating Expenses as provided in the Lease.
(b) The second and third sentences of the second paragraph of Section 3(a) of the Lease are hereby deleted in their entirety and replaced with the following: “Tenant shall not be required to pay Base Rent with respect to the office portion of the Premises, consisting of approximately 958 rentable square feet, for the 13th and 14th months of the Base Term. Tenant shall commence paying Base Rent with respect to the entire 2,421 rentable square feet of the Premises on the first day of the 15th month of the Base Term.”
Base Rent and Operating Expenses. Paid Upon Execution: $44,280.00 as Base Rent and Operating Expenses for the period January 1-31, 2013.
Base Rent and Operating Expenses. Tenant shall continue paying Base Rent as provided for in the Lease through April 30, 2025. Commencing on May 1, 2025, and continuing through the Fifth Amendment Expiration Date, Tenant shall continue to pay Base Rent at the rental rate in effect as of April 30, 2025, which shall be calculated in accordance with Section 4 of the Original Lease. For avoidance of doubt, Xxxxxx shall continue to pay Xxxxxx’s Share of Operating Expenses through the Fifth Amendment Expiration Date in accordance with the terms of the Lease.
Base Rent and Operating Expenses. Tenant shall continue to pay, through the Termination Date, all amounts due and owing under the Lease including, without limitation, Base Rent and Operating Expenses as provided under the Lease. Notwithstanding the foregoing, if Tenant does not surrender the Premises on or before the Termination Date, Tenant shall be in holdover under the Lease and the terms of Section 8 of the Lease shall apply.
Base Rent and Operating Expenses. Notwithstanding anything to the contrary contained in the Lease, so long as Tenant is not then in default under the Lease, Base Rent and Operating Expenses shall be abated for the period commencing on January 1, 2024 through the earlier of (i) the Termination Date and (ii) 30 days after the “Commencement Date” (as such term is defined in the GAC Lease) of the GAC Lease (such period, the “Abatement Period”). For the avoidance of doubt, Tenant shall remain obligated to pay all other amounts due and payable under the Lease during the Abatement Period, including, without limitation, charges for all Utilities used on the Premises. Tenant shall not be required to pay Base Rent or Operating Expenses for any period following the Termination Date so long as Tenant surrenders the Premises in strict compliance with this Agreement and the Lease, and Tenant is not in breach hereof or under the Lease.
Base Rent and Operating Expenses. (b) Commencing on the later to occur of (i) the Expansion Date or (ii) the date Expansion Area One is turned over to Lessee, (a) Lessee shall be responsible for the payment of Operating Expenses on both the Original Premises and Expansion Area One in accordance with the terms and conditions of Paragraph 4.2 of the Lease, and (b) Lessee’s Share under the Lease shall equal 30.49%. Until the Expansion Date, Lessee shall continue to be responsible for making all payments to Lessor for the Original Premises in accordance with the Lease, as amended hereby. In the event Expansion Area One is not turned over to Lessee on or prior to September 1, 2005, the free Base Rent period with respect to such premises shall be adjusted accordingly.
Base Rent and Operating Expenses. For purposes of calculating Tenant's Proportionate Share of Operating Expenses, a year shall mean a calendar year except the first year, which shall begin on the Commencement Date, and the last year, which shall end on the expiration of this Lease. With respect to Operating Expenses which Landlord allocates to the entire Project, Tenant's "Proportionate Share" shall be the percentage set forth on the first
Base Rent and Operating Expenses. Notwithstanding anything to the contrary contained in the Lease, so long as Tenant is not then in Default under the Lease, for the period commencing on the date of this Second Amendment through the Termination Date (the “Abatement Period”), Tenant shall not be required to pay Base Rent under the Lease. Tenant shall continue to pay Operating Expenses (including administration rent each month equal to the amount of the administration rent that Tenant would have been required to pay in the absence of there being an Abatement Period) and all other amounts due under the Lease during the Abatement Period. In addition, Tenant shall continue to be responsible for all of its other obligations under the Lease. Notwithstanding the foregoing, if the New Lease is terminated before the Commencement Date (as defined in the New Lease), then commencing on the date the New Lease is so terminated, Tenant will resume paying the full Base Rent due under the Lease and, within 10 calendar days after the termination of the New Lease, Tenant shall deliver to Landlord an amount equal to the Base Rent that would have otherwise been payable during the Abatement Period but for the abatement provided for in this Section 2.
