Common use of Battery Leave Clause in Contracts

Battery Leave. 1. An employee injured by an assault and/or battery while acting in the scope of the employee’s duties may be granted up to ten (10) days leave with pay by the Human Resources Director. 2. Leave granted shall not be considered as precedent for future battery leave requests. 3. Any employee battered shall report the incident to his/her immediate supervisor immediately. The supervisor shall be certain all necessary reports and/or forms are completed. 4. Employees injured by an assault and/or battery while acting in the scope of the employee’s duties shall be eligible for Workers’ Compensation in accordance with New Mexico law.
