Bobtail Insurance. Drivers shall be required to provide bobtail insurance where equipment is being used for personal use if the Employer consents to such use, but the company insurance shall prevail where truck is being taken to repair shop or hauling automobiles, trucks or tractors. (a) The Employer shall not require as a condition of continued employment that an employee purchase truck, tractor and/or tractor and trailer and other vehicular equipment, except that conditions at railheads or local understandings shall be maintained. (b) If an owner-operator is required by the Employer to buy a new truck, he shall be guaranteed minimum equipment earnings of one thousand dollars ($1,000.00) per month for three (3) years. Prior to requiring purchases of equipment the Employer shall notify the owner-operator, in writing. If the owner-operator desires to replace his equipment, the owner-operator shall first consult with the Employer and get instruction in writing. If the Employer does not permit the owner-operator to replace equipment, the Employer shall furnish him with a piece of comparable equipment in line with his seniority.

Bobtail Insurance. Contractor will obtain, maintain, and keep in force at its expense, or if Carrier consents, Contractor authorizes Carrier to purchase at such cost to Contractor as may be set forth from time to time in the Schedule of Compensation, a so-called Bobtail or Unladen Liability Insurance policy for public liability and property damage expenses with limits of liability of not less than One Million Dollars ($1,000,000.00) per occurrence. The insurance policy and coverage will apply to the use and operation by Contractor of the Equipment during any such time that the Contractor is not using the equipment to perform a trip specifically assigned to the Contractor by the Carrier. In the event the insurance is obtained directly by Contractor, Contractor will provide Carrier with evidence of such insurance in a form satisfactory to Carrier and the policy shall name Carrier as an additional insured.

(c) Should the Employer cancel the lease of any owner-operator for other than a dischargeable offence, under the terms of Article 47, the Employer shall within thirty (30) days thereafter assist in selling the equipment at fair market value or purchase said equipment at fair market value. An owner-operator found guilty of putting equipment down without cause or refusing to abide by reasonable codes of upkeep may be subjected to discipline up to and including discharge. Where an Employer operates or opens a new operation or terminal using only brokers/owner-operators covered by this Agreement, which does not affect in whole or in part employees in any other terminal of an Employer party to this Agreement, the Employer shall provide the employees who are entitled to follow their work to the terminal with such financial assistance as is necessary to purchase their equipment.

  • INDUSTRIAL INSURANCE It is understood and agreed that there shall be no Industrial Insurance coverage provided for Contractor or any Sub-Contractor of the Contractor by the City. Contractor agrees, as a precondition to the performance of any work under this Agreement and as a precondition to any obligation of the City to make any payment under this Agreement to provide City with a certificate issued by an insurer in accordance with NRS 616B.627 and with a certificate of an insurer showing coverage pursuant to NRS 617.210. It is further understood and agreed by and between City and Contractor that Contractor shall procure, pay for, and maintain the above mentioned industrial insurance coverage at Contractor's sole cost and expense. Should Contractor be self-funded for Industrial Insurance, Contractor shall so notify City in writing prior to the signing of this Contract. City reserves the right to approve said retentions, and may request additional documentation, financial or otherwise, for review prior to the signing of this Contract. CONTRACTOR shall maintain coverages and limits no less than:

  • Insurance The Company and the Subsidiaries are insured by insurers of recognized financial responsibility against such losses and risks and in such amounts as are prudent and customary in the businesses in which the Company and the Subsidiaries are engaged, including, but not limited to, directors and officers insurance coverage. Neither the Company nor any Subsidiary has any reason to believe that it will not be able to renew its existing insurance coverage as and when such coverage expires or to obtain similar coverage from similar insurers as may be necessary to continue its business without a significant increase in cost.

  • Medical Insurance The Company shall provide to Executive, Executive's spouse and children, at its sole cost, such health, dental and optical insurance as the Company may from time to time make available to its other executive employees.

  • Additional Insurance Contractor may obtain additional insurance not required by this Contract.

  • Industrial Insurance Coverage The Contractor shall comply with the provisions of Title 51 RCW, Industrial Insurance. If the Contractor fails to provide industrial insurance coverage or fails to pay premiums or penalties on behalf of its employees, as may be required by law, Agency may collect from the Contractor the full amount payable to the Industrial Insurance accident fund. The Agency may deduct the amount owed by the Contractor to the accident fund from the amount payable to the Contractor by the Agency under this contract, and transmit the deducted amount to the Department of Labor and Industries, (L&I) Division of Insurance Services. This provision does not waive any of L&I’s rights to collect from the Contractor.

  • Fire Insurance The LESSEE shall not permit any use of the leased premises which will make voidable any insurance on the property of which the leased premises are a part, or on the contents of said property or which shall be contrary to any law or regulation from time to time established by the New England Fire Insurance Rating Association, or any similar body succeeding to its powers. The LESSEE shall on demand reimburse the LESSOR, and all other tenants, all extra insurance premiums caused by the LESSEE's use of the premises.
