Budget Plans. As the result of having no new signed agreement, the MSI Board, (with the help of our management company, Management Consultants Hawaii), has been working to set up a 2013 Operating Budget for both Associations. Since the MSI Board is responsible for setting the budget, according to the 1967 Agreement, we are discussing repairs needed to keep our property running. The 1967 Agreement is clear about the MSI Board being responsible for maintaining all buildings and the property. Thus, we will be following that dictate until such time that the Agreement is either terminated, which is slated to end in December, 2013, (based on your Board's letter of termination to the MSII Board) or a reasonable solution can be found for both Associations. Our goal is to develop a budget that no longer allows our property to fall into disrepair. We also will be following the 1993 surcharge amount charged to the MSII owners for use of our property. We allow MSII to use our pool, mailbox area, parking, laundromat, and sewer and water lines, to name a few. We have been charging "rent" for use of the areas which are on MSI property. In the new budget, the operating costs will be divided equally 75 ways among all the owners (Maui Sands I and II). The surcharge paid by MSII owners will be deposited into the Maui Sands I reserves to be used to further improve the property. In the past, the surcharge has been deposited back into the Operating Budget to reduce maintenance fees. The fees have stayed the same since 2008. This has led to serious issues regarding the normal care of our property. Your Maui Sands I Board Your elected Board has been professional and willing to negotiate during these difficult times. As you are aware, at least one owner does not believe we should have negotiated at all. Yet, because we are striving to work out a neighborly solution with those who live so close to us, we have been willing to listen to issues that have arisen over the years between Xxxx Xxxxx I and Maui Sands II. Landlord’s approval of or objection to revised Draft Schematic Plans and Tenant’s correction of the same shall be in accordance with this Section until Landlord has approved the Draft Schematic Plans in writing or been deemed to have approved them. The iteration of the Draft Schematic Plans that is approved or deemed approved by Landlord without objection shall be referred to herein as the “Approved Schematic Plans.”
