Business Representatives and Union Officials. Full time representatives of the Union shall have access to the Company's operations for the purpose of contacting Stewards regarding employee Complaints or grievances or matters arising out of the application of this Agreement. Such visits shall be subject to such regulations as may be made from time to time by the Company, the U.S. Military Services, and other government agencies. It is agreed that the Company will not impose regulations, which will render ineffective the intent of this provision. Prior to entering the Company's operations, the Business Representative shall notify the Program Manager or his/her designee on the date and time he/she will be on the facility. While in Company areas requiring badging, the Union Representative(s) shall be escorted at all times by a Company representative that has been designated by the Division Manager. The Union Representative(s) must remain in non-work areas unless in the investigation of a grievance, his/their presence in a non-working area is considered to be essential as decided by the Division Manager. The failure of any Union Representative(s) to follow the procedures outlined above will be considered just cause to permanently bar said Representative(s) from the premises.

It is agreed that the Company will not impose regulations which will render ineffective the intent of this provision. Prior to entering the Company’s operations, the Business Representative shall provide the Project Manager reasonable advance notice on the date and time he/she will be on the facility and the department(s) he/she wishes to contact.

  • Parties’ Representatives Both Parties shall ensure that throughout the term of this Agreement, a duly appointed Representative is available for communications between the Parties.   • DEPARTMENT'S REPRESENTATIVE The Contract Administrator shall be the Department's representative during the period of this Contract. He/she has authority to curtail services if necessary to ensure proper execution. He/she shall certify to the Department when payments under the Contract are due and the amounts to be paid. He/she shall make decisions on all claims of the Provider, subject to the approval of the Commissioner of the Department.

The Association may select as many as five (5) members of the Association to attend during regular duty or work hours without loss of compensation, meetings scheduled with the Civil Service Commission, the Department of Human Resources, the Director of Employee Relations, or designee, when such meetings have been scheduled for the purpose of meeting and conferring on matters within the scope of representation affecting such appropriate unit, and to participate in the discussions, deliberations, and decisions at such meetings.

  • Representatives and Notices Each Party nominates as its representative for this Agreement the person set out on the first page of this Agreement under ‘Contact for Notices’ (“Representative”). MATERIALS In the event that a Party (Provider) provides the other Party (User) with Material: the Material will be solely owned by the Provider; the User must store, handle and use the Material in compliance with all applicable legislation, regulations, codes and guidelines; the User must use the Material solely for the purpose of the Project and for no other purpose; the User must not use the Material in human subjects; the User must not, without the prior written consent of the Subject: transfer, distribute or disclose the Material to any third party external to the User; use the Material for commercial, diagnostic or therapeutic purposes; acknowledges that the Material are: experimental in nature and may have defects, deficiencies and hazardous properties; provided by the Provider without warranty, express or implied, and to the full extent permitted by law, all warranties related to the Material are excluded; and stored, handled and used at the Users’ sole risk. To the extent that the Provider has any legal rights in the Material, the Provider grants to the User a non-exclusive royalty free, transferable, worldwide licence to use, adapt and modify the Material for the purpose of performing the Project and carrying out its obligations under this Agreement and in accordance with the relevant Clinical Subject consent. Following termination of a Project and upon receipt of a written request by the Provider, the User must promptly return to the Provider (at the Provider’s expense) or destroy any unused Materials.

  • Contractor’s Representative Contractor hereby designates [***INSERT NAME OR TITLE***], or his or her designee, to act as its representative for the performance of this Agreement (“Contractor’s Representative”).
