Division Manager. If the grievance is not resolved by the immediate supervisor, the grievant may file a written appeal with the grievant’s Division Manager, to be submitted within 10 working days of receipt of the decision of the immediate supervisor. The written grievance shall set forth (a) the facts,
Division Manager. If the grievance has not been resolved at Step 1, the grievance may be filed with the Division Manager or his/her representative within ten (10) calendar days, not including Saturdays, Sundays, or holidays, after the response is received or was due from the supervisor. The grievance shall be in writing, shall state the nature of the grievance, the Article of the contract allegedly violated, and the remedy being sought. The Division Manager or his/her representative shall contact the Human Resources Office and the grievant shall contact his/her labor representative and provide them with a copy of the grievance form. The Human Resources Office and the Union will work together to arrange a meeting within thirty (30) calendar days of receipt of the grievance by the Division Manager, at which meeting the parties shall attempt to resolve the matter. This period may be extended for a reasonable period as needed by the Employer to conduct an investigation of the issue or issues raised by the grievance, or as needed to investigate additional issues raised at any other step in the grievance procedure. The Employer will notify the Union in writing of its use of any such extension period. The period of investigation will not be extended beyond an additional forty- five (45) days without mutual consent.

Within ten (10) working days of being notified of the grievance, the division manager shall meet with the grievant, investigate the alleged grievance, and provide the grievant an answer. Note: This step of the process should be repeated when two levels of management exist between the immediate supervisor and the Department Head.

If after thorough discussion with the immediate 9 supervisor the grievance has not been satisfactorily resolved, the employee and his/her Association 10 representative shall then present the grievance to the Division Manager for investigation, discussion, 11 and written reply. The Division Manager or designee shall meet with the employee and his/her 12 Association representative. The Division Manager or designee will contact the employee and the 13 Association representative within ten (10) working days of receipt of the written grievance, to 14 schedule the meeting. Every effort will be made to schedule this meeting within twenty (20) working 15 days of the receipt of the written grievance by the Division Manager. Whenever possible, grievance 16 meetings will be held during the employee’s regular working hours. The Division Manager or 17 designee, after consulting with the Department Director, shall make a written decision available to 18 the aggrieved employee with a copy mailed to the Association representative within ten (10) working 19 days after the meeting. If the grievance is not pursued to the next higher level within ten (10) 20 working days from the Association’s receipt of the Division Manager’s written decision, it shall be 21 presumed resolved.

The written grievance shall include the required information from [Section 30.2]. The Division 20 Manager/designee will contact the Association representative within (15) calendar days of receipt of 21 the written grievance to schedule the meeting. Every effort will be made to schedule this meeting 22 within (25) calendar days of the receipt of the written grievance by the Division Manager or designee.

If after thorough discussion with the immediate 17 supervisor the grievance has not been satisfactorily resolved, the Association representative shall then 18 present the grievance to the Division Manager/designee for investigation, discussion, and written reply. 19 The written grievance shall include the required information from [Section 30.2]. 20 The Division Manager/designee will contact the Association representative within fifteen(15) 21 calendar days of receipt of the written grievance to schedule the meeting. Every effort will be made to 22 schedule this meeting within twenty-five (25) calendar days of the receipt of the written grievance by 23 the Division Manager or designee. If applicable, the grievance meeting should be held during a 24 xxxxxxxx’ s regularly scheduled working hours if the Association has asked the grievant to attend. The 25 Division Manager/designee after consulting with appropriate management stakeholders shall make a 26 written decision available to the Association representative within fifteen (15) calendar days after the 27 meeting. If the grievance is not pursued to the next higher level within fifteen (15) calendar days from 28 the Association’s receipt of the Division Manager’s written decision, it shall be presumed resolved.

POLICE CHIEF (OR FIRE CHIEF with regard to the “Battalion Fire Chief” classification) If the grievance is not resolved in Step II, the grievant may submit a written grievance to the Police Chief (or Fire Chief with regard to the “Battalion Fire Chief” classification) within ten (10) working days of receiving the Step II response. The written grievance shall contain the following information:
1. The name of the grievant(s).
2. The specific nature of the grievance.
3. The date, time and place of the event or action on which the grievance is based.
4. The provision(s) of the agreement or rule(s) alleged to have been violated.
5. Xxxx discussed with supervisor and a copy of the supervisor’s response if that response was in writing.
6. The action of the grievant believes will resolve the grievance.
7. The name of the representative(s), if any, chosen by the grievant to participate in the grievance procedure. If the Police Chief (or Fire Chief with regard to the “Battalion Fire Chief” classification) believes the grievant has failed to provide this information, he/she shall inform the grievant of the deficiency(ies) and the grievant shall be given five (5) working days to perfect and resubmit the grievance. The Police Chief (or Fire Chief with regard to the “Battalion Fire Chief” classification) shall investigate the issues, meet with the grievant, and attempt to reach a satisfactory resolution of the grievance. No later than ten (10) working days after receipt of the grievance, the Department Head shall issue a written response. Copies of the response shall be sent to all parties involved in the grievance, including the employee, the employee’s representative(s), the immediate supervisor and managers, and the Human Resources Manager.
