Buyer’s Data. Notwithstanding the foregoing sentence, for so long as Seller is hosting and operating the Enlighten monitoring service pursuant to Section 17.1, Seller shall have, and Buyer does hereby grant to Seller, a right of limited access and use of the Data generated in connection with the Enlighten monitoring services for Seller’s internal purposes and analysis, including ongoing research and development, and such development may lead to the development of other products which may be offered for sale by Seller. Seller may, without the prior written consent of Buyer, disclose Data to Persons other than Buyer so long as (a) the customer data is anonymous, meaning that the data shall not contain any personal identifying information or other sensitive information, including, without limitation: site location, site photos, address, site owner, system owner, installer, equipment types, and other system-specific information; (b) customer data is aggregated with other customer data; and (c) customer data comprising such aggregate data set comprises a representative sample of the entire data set.
Buyer’s Data. Seller shall not use or disclose any data, designs, or other information belonging to or furnished by or on behalf of Buyer.

Buyer’s Data. Seller shall store and use all data that concern the business relationship between Buyer and Seller under consideration of the provisions of German and European Data Protection Act.
Buyer’s Data. “Buyer Data” means all data, information or other content and materials (a) transmitted or provided to Seller by Buyer or a third party on behalf of Buyer, or (b) uploaded by or for Buyer via the Item and processed by or for Buyer using the Services.
Buyer’s Data. Buyer represents and warrants that: (a) all Buyer’s Data it provides to Seller hereunder is owned by Buyer or Buyer has the right to provide such Buyer’s Data to Seller for use by Seller in connection with these Standard Terms; and (b) any authorized processing of Buyer’s Data by Seller does not and will not violate or infringe the intellectual property, privacy or publicity rights of any third party, or any applicable data privacy and security Laws.
Buyer’s Data. Buyer acknowledges that Seller has relied upon all specifications, information, representation of operating conditions and other data supplied by Buyer to Seller in the selection and design of the Products and the preparation of this Quotation and Contract. In the event that actual operating conditions or other conditions differ from those represented by Buyer and relied upon by Seller, any warranties contained herein which are affected by such conditions shall be null and void, unless otherwise mutually agreed in writing, and any modification to the Products necessitated thereby shall be subject to the provisions of Section 7 CHANGE OR CANCELLATION.
Buyer’s Data. Seller shall inform Buyers of and, where legally required, obtain their consent for any collection, storage, processing, modification, disclosure, or other use of Buyers‘ data in connection with the Seller Product. Where required, Seller shall conclude adequate data protection terms with Buyers.
Buyer’s Data. The output of the base software is buyer’s data and is owned by buyer. seller must not without buyer’s prior written consent remove buyer’s data or allow buyer’s data to be removed from buyer’s premises.
Buyer’s Data. 12.3.1 seller must maintain any buyer’s data it holds securely and in accordance with Item 31 of Schedule B.
12.3.2 seller is permitted to access and use buyer’s data for the sole purpose of performing this contract. seller has no rights in relation to buyer’s data.
12.3.3 Unless authorised by buyer in a notice to seller, buyer must not conduct any data mining activities in respect of buyer’s data.
12.3.4 Unless authorised by buyer in a notice to seller, seller must not do anything to transfer custody or ownership of buyer’s data to a third party.
12.3.5 seller must provide buyer access to buyer’s data as requested by buyer in a notice to seller.
12.3.6 buyer may at any time issue reasonable directions to seller in a notice to comply with archival and information management requirements for buyer’s data that are necessary or desirable to enable buyer to comply with government policy. Subject to clause 12.3.7, seller must comply with such directions.
12.3.7 If seller (acting reasonably) considers complying with a direction under clause 12.3.6 would materially increase its costs of performing this contract, within 15 business days it must notify buyer and propose a change to the contract under clause 16.1 to give effect to buyer’s direction under clause
