Capacity Use. Each party shall have the right to use its allocated capacity on the Shared Channel in any way it sees fit in accordance with this Agreement (subject to compliance with the Channel Sharing Rules, and with all Communications Laws (as defined below) and other applicable laws). Sharer shall have the right, exercisable in its sole discretion in accordance with the Communications Laws, to sublease, transfer or otherwise dispose of any portion of the spectrum allocated for its use under this Agreement and its rights under this Agreement, which right shall include the right to enter into a multicast affiliation agreement, local marketing agreement, time brokerage agreement, or similar third-party arrangement with respect to Sharer’s portion of the Shared Channel (a “Sub-Sharing Arrangement”). Xxxxxx shall not enter into any Sub-Sharing Arrangements within its allocated capacity without the prior consent of Sharer.

Capacity Use. In the event the LNG regasification and receiving terminal operated by the Partnership has excess capacity that is made available to any Partner or any Affiliate of any Partner, such capacity will be made available to all Partners on the same terms and price pro rata based upon their Percentage Interest.
Capacity Use. Each Member Agency will have the right to use its Treatment Capacity for the treatment and disposal of Wastewater by the Project. No Member Agency shall in any way grant, encumber, limit or restrict its interest in any part of the Project for any purpose other than treatment and disposal of Wastewater, or use the Project or any part thereof to a greater extent than its Treatment Capacity without the prior written consent of the Authority’s Board of Directors.

  • Interconnection Customer Drawings Within one hundred twenty (120) days after the date of Initial Operation, unless the Interconnection Parties agree on another mutually acceptable deadline, the Interconnection Customer shall deliver to the Transmission Provider and the Interconnected Transmission Owner final, “as-built” drawings, information and documents regarding the Customer Interconnection Facilities, including, as and to the extent applicable: a one-line diagram, a site plan showing the Customer Facility and the Customer Interconnection Facilities, plan and elevation drawings showing the layout of the Customer Interconnection Facilities, a relay functional diagram, relaying AC and DC schematic wiring diagrams and relay settings for all facilities associated with the Interconnection Customer's step-up transformers, the facilities connecting the Customer Facility to the step-up transformers and the Customer Interconnection Facilities, and the impedances (determined by factory tests) for the associated step-up transformers and the Customer Facility. As applicable, the Interconnection Customer shall provide Transmission Provider and the Interconnected Transmission Owner specifications for the excitation system, automatic voltage regulator, Customer Facility control and protection settings, transformer tap settings, and communications.

  • Interconnection Customer (1) Interconnection Customer shall construct and, unless otherwise indicated, shall own, the following Interconnection Facilities: None (2) In the event that, in accordance with the Interconnection Construction Service Agreement, Interconnection Customer has exercised the Option to Build, it is hereby permitted to build in accordance with and subject to the conditions and limitations set forth in that Section, the following portions of the Transmission Owner Interconnection Facilities which constitute or are part of the Customer Facility: None Ownership of the facilities built by Interconnection Customer pursuant to the Option to Build shall be as provided in the Interconnection Construction Service Agreement.
