Common use of Christmas Shutdown Clause in Contracts

Christmas Shutdown. (a) For the Christmas Shutdown period, as identified in 16.01, a level up to sixty percent (60%) of regular staffing in all departments/classifications, excluding I.T. (b) A notice will be posted and the employees can volunteer to make a commitment to work the days indicated. The Company will attempt to achieve its minimum staffing levels on a voluntary basis, failing which we will achieve our minimum levels with the lowest seniority people who are able to provide the necessary service. Efforts will be made to move or transfer influx volunteers to other classifications who have the skill and ability to mitigate force ins by seniority. (c) For departments listed in 16.08 (a), which have Bilingual posted roles, up to sixty percent (60%) is to be maintained in both the English and Bilingual positions. (d) When possible flex-time hours will be honoured during shutdown. (e) The Company agrees to not include December 24th as a necessary date to provide these services. (f) The employee will be given a choice to be compensated for all hours worked on any of the dates defined below as follows: (i) The employee can be paid at the rate of one time their base hourly rate in addition to their holiday pay for the day plus they will be given a day off in lieu of the holiday; or (ii) The employee can be paid at a rate of two times their base hourly rate in addition to their holiday pay for the day. (g) The applicable days of the Christmas Shutdown will be determined by September 1st of each respective year. (h) Employees will be offered the opportunity to work Christmas Shutdown. Those who fail to respond by the deadline provided, after receiving a reminder, will be deemed to be working the Christmas Shutdown and will be compensated according to (f) (ii) above (i) Employee selection sheets will be available no later than October 15th at 11:59 a.m. Employees will make their selection to work Christmas Shutdown by seniority, no later than the last Friday in October at 11:59 a.m. Those required to work, will be notified in writing no later than the third Friday in November by 11:59 a.m. The schedule will be posted to those required to work no later than the first Friday in December at 11:59 a. m. The parties can mutually agree to adjust dates. (j) If an employee is scheduled to work Christmas Shutdown or Easter Monday and are eligible for bereavement in accordance with Article 14.06, they shall receive the time off and pay in accordance with their entitlement. They will receive eligible Holiday Pay in addition to any paid bereavement in accordance with Article 16. If the employee is not scheduled to work and the bereavement day(s) falls on a Holiday as listed in Article 16, they will receive their entitlement on the first scheduled working day after the Christmas Shutdown, Easter Monday or when funeral arrangements take place.

Christmas Shutdown. A. The Company will schedule a Christmas Shutdown, except for employees who are required to work, beginning on Christmas Eve Day (aor the day observed as the Christmas Eve Day holiday) For and continuing through New Year's Day (or the day observed as the New Year's Day holiday). Employees on the active payroll on 1 December of the year of the shutdown or employees who return to work after 1 December and who are not scheduled to work during this period and who had one (1) year or more of continuous employment as of 1 December will be compensated for the three (3) regular workdays during this period which are not observed as holidays. B. Employees in the following work areas may be required to work during the Christmas Shutdown period, as identified i.e., Powerhouse, Maintenance, Receiving, and Repair Parts Shipping. In those instances where only part of the employees in 16.01the above work areas, a level up i.e., Powerhouse, Maintenance, Receiving, and Repair Parts Shipping are scheduled to sixty work during this period, employees will be offered work on the following basis: (1) First, to the senior employees in the classification within the department, before, (2) Employees within the classification and department are required to work on the basis of reverse seniority, i.e., the least senior first. C. This compensation for such three (3) days will be on the basis of one and one-quarter percent (601.25%) of regular staffing the employees' earnings as set out in all departments/classificationsSection 7, excluding I.T. Christmas Shutdown. (a) For It is understood and agreed that the Employer may schedule a shutdown of its operations between the Christmas Shutdown and New Year’s Holidays in any year. Such vacation shutdown may be preceded by the weekend prior to Christmas Day and the weekend following New Year’s Day, or may be for a longer period agreed to in advance by the Employer and the Union. b) In the event that the Employer implements a shutdown during the Christmas period, as identified an Employee may request and receive a combination of the time off, for any of the days the Employee would normally have worked during the period of the shutdown which are not covered by Paid Holidays, in 16.01accordance with the following: i) unused annual vacation entitlement; ii) banked overtime, floating holidays and/or lieu days; iii) unpaid leave of absence. c) The Employer shall provide all Employees with a level up minimum of ninety (90) calendar days prior written notice of a planned Christmas shutdown. d) Where the Employer has a requirement for work to sixty percent (60%be performed during a Christmas shutdown period, the performance of such work by any Employee shall be subject to the following: i) of regular staffing The Employer shall ask, in all departments/classificationsseniority order, excluding I.T. This provision shall receive not apply to circumstances beyond the time off and pay in accordance with their entitlement. They will receive eligible Holiday Pay in addition to any paid bereavement in accordance with Article 16. If control of the employee is not scheduled to work and the bereavement day(s) falls on a Holiday as listed in Article 16, they will receive their entitlement on the first scheduled working day after the Christmas Shutdown, Easter Monday or when funeral arrangements take placeEmployer.
