City Release. WITHOUT LIMITING CITY’S INDEMNITY OBLIGATIONS UNDER THIS AGREEMENT, CITY HEREBY RELEASES TENANT AND ITS AFFILIATES AND RELATED PARTIES FROM AND AGAINST ANY CLAIMS, DEMANDS, ACTIONS, SUITS, CAUSES OF ACTION, DAMAGES, LIABILITIES, OBLIGATIONS, COSTS AND/OR EXPENSES THAT CITY MAY HAVE WITH RESPECT TO THE BALLPARK OR THE BALLPARK DEDICATED PARKING AND RESULTING FROM, ARISING UNDER OR RELATED TO ANY ENVIRONMENTAL EVENT WITHIN THE SCOPE OF CITY’S REMEDIAL WORK, INCLUDING ANY SUCH CLAIM UNDER ANY ENVIRONMENTAL LAWS, WHETHER UNDER ANY THEORY OF STRICT LIABILITY OR THAT MAY ARISE UNDER THE COMPREHENSIVE ENVIRONMENTAL RESPONSE, COMPENSATION AND LIABILITY ACT OF 1980, AS AMENDED, 42 U.S.C.A. § 9601, ET. SEQ., AND TITLE 22a OF THE CONNECTICUT GENERAL STATUTES, AS AMENDED.

City Release. Except as to such rights or claims as may be created by this Agreement, the City hereby releases and discharges WMB and its respective agents, brokers, employees, representatives, predecessors, successors, assigns, parents, subsidiaries, related entities, sureties, consultants, advisors, officers, directors, board members, administrators, executors, shareholders, attorneys, and insurers, and each of them from, and relinquishes, extinguishes and waives as to such parties, any and all claims, counterclaims, disputes, demands, liabilities, controversies, causes of action, damages, costs, expenses and attorneys’ fees of any kind or nature, whether legal or equitable, in tort or contract, actual or contingent, patent, known or unknown, asserted or unasserted, that it ever had, now has, or may have that in any way arise out of or relate, directly or indirectly, to the Claims.
City Release. City, on behalf of itself, its predecessors, successors, affiliates, assigns, officers, officials, departments, boards, commissions, agents, insurers, sureties, employees, representatives, attorneys, and persons acting by, through, under, or in concert with them (collectively “Indemnitors”), hereby fully release(s) and forever discharge(s) MBI, its predecessors, successor, direct and indirect parent companies, direct and indirect subsidiary companies, companies under common control with any of the foregoing, affiliates and assigns and its and their past, present, and future officers, directors, shareholders, interest members, subcontractors, officials, employees, successors, assigns, agents, representatives and attorneys (collectively “Indemnitees”), from and against any and all known or unknown charges, complaints, claims, grievances, rights, demands, actions, causes of action, liens, judgments, losses, debts, liabilities, damages, costs, expenses, penalties, fees, wages, contributions, and attorneys’ fees, of whatever nature, past or present or future, whether in law or in equity, whether under local, state or federal law, and whether known or unknown, that any of the Indemnitors have and/or may have had against any of the Indemnitees, whether or not apparent or yet to be discovered, or which may hereafter develop, for any acts or omissions arising from or related to the Dispute or any other allegation that Indemnitees are responsible for indemnifying any of the Indemnitors for contributions City must make to CalPERS. However, nothing in this Agreement releases either Party from liability for the failure to perform any term or condition as set forth within this Agreement.
City Release. Subject to the terms of this Agreement, the City upon the District providing the District Funding (as defined hereinafter) and HDDA completing the HDDA Work (as defined hereinafter) with respect to the demolition of buildings on the HDDA owned property agrees to release the City’s declaration of Dangerous Building previously recorded on that portion of the property comprising the Project Area. The Parties understand that the City will be entitled to certain revenues in accordance with the terms of the Cooperative Agreement between the City, the Developer, and the District as may be amended from time to time and this Agreement. HDDA and Developer agree that the City may utilize revenues it is entitled to under Paragraph 4 of this Agreement to reimburse the City for the City’s financial contribution or any other costs that the City may incur due to the development in Redevelopment Project Area 4.
City Release. Upon Subdivider completing all City Required Subdivision Improvements, and complying with all requirements of the COA Standard Specifications Series 1800S – Private Development, Construction Requirements and Procedures, and upon DSD Director’s receipt of notice from the Construction Inspection Division of acceptance of all Subdivision Improvements, the Fiscal Deposit will be released and this Agreement will be terminated. If any item is missing or incomplete, this Agreement remains in effect.
City Release. Upon the entry of the Agreement, Petitioner City of Newport Beach and all its heirs, administrators, representatives, attorneys, successors, and assigns, hereby release, waive, acquit, and forever discharge the FAA and all its respective officers, employees, and agents from, and are hereby forever barred and precluded from prosecuting, any and all claims, causes of action, and/or requests for relief asserted in City of Newport Beach v. FAA, No. 17-1008 (D.C. Cir.), as well as any and all claims, causes of action, and/or requests for relief, whether or not made, against any Party that could have been raised in those matters, with the exception of proceedings to enforce this Agreement.
City Release. (A) City, on its behalf and on behalf of Releasing Parties and anyone else acting on Releasing Parties’ behalf, waives, releases, and forever discharges EMC Group from any and all Claims arising out of or in any way related to the Revocable Permit, except for any surviving indemnity obligations under Section 21 of the Revocable Permit.

  • Escrow Agent Not Responsible after Release The Escrow Agent will have no responsibility for escrow securities that it has released to a Securityholder or at a Securityholder’s direction according to this Agreement.

This release shall not affect any accrued rights Employee may have under any medical insurance, workers compensation or retirement plan because of Employee's prior employment with Company. EMPLOYEE ACKNOWLEDGES AND AGREES THAT THROUGH THIS RELEASE EMPLOYEE IS GIVING UP ALL RIGHTS AND CLAIMS OF EVERY KIND AND NATURE WHATSOEVER, KNOWN OR UNKNOWN, CONTINGENT OR LIQUIDATED, THAT EMPLOYEE MAY HAVE AGAINST COMPANY AND THE OTHER PERSONS NAMED ABOVE, EXCEPT FOR THE RIGHTS SPECIFICALLY EXCLUDED ABOVE.
