Classified Employees. If classified employees from the Xxxxx Trace School District wish to be considered for reemployment, they must indicate this to the superintendent, prior to May 1, of the year of their potential retirement. Their request must include a letter of resignation that states that their resignation is contingent upon being reemployed with the district. The resignation letter requested under this provision must be received by the superintendent 5 working days prior to the upcoming announced board meeting. If the request is received within 5 working days of a board meeting, the request may be tabled until the next scheduled board meeting. The superintendent will notify the classified employee of the board's decision on reemployment within 2 days of the board meeting. If a classified employee is rehired, retired classified employees will be placed at step 7 on the appropriate classified employee salary schedule. If the employee was not past this level on the salary schedule, they will be placed at the last level occupied. Rehired retired classified employees will progress on the salary schedule each year following their initial placement. Except as provided for under this agreement, all provisions of the contract will be maintained; however, a rehired retired classified employee will not be entitled to severance pay a second time. Rehired retired classified employees will NOT accrue seniority for the purposes of reduction in force. At their option, rehired retired classified employees will be eligible for board-provided single employee health insurance coverage at the contracted premium rate. Those rehired retired classified employees electing not to take such coverage shall be eligible for an annuity as per contract provisions for classified employees under the single plan. Rehired retired classified employees from the Xxxxx Trace School District will start out at up to 15 days sick leave, provided they had extra days accumulated that were not paid for as part of the severance package. Prior employment in the district is no guarantee of post-retirement employment or a particular assignment if reemployed with the district. Rehired retired classified employees shall be issued a one-year limited contract that shall automatically non-renew on each April 30th. The superintendent must notify each rehired retired classified employee prior to April 30th if he/she intends to renew the limited contract. Evaluations, as otherwise provided for under this contract, shall not be required for retired classified employee rehired under this agreement. A retired classified individual from outside the district, who wishes to be employed by the Xxxxx Trace Board of Education, shall adhere to all provisions of this agreement with the exception of paragraph one and two above. For any employee who is less than full-time, the provisions for annuities and insurance will be pro-rated by the Board.

If a classified employee is rehired, retired removed or dismissed as a result of a decision of the school board to decrease the number of classified employees will employed by the board or to discontinue some particular type of educational support service, written notice shall be placed given the employee by certified mail at step 7 least 60 days before the end of the school term, together with a statement of honorable dismissal and the reason therefore. In the event of layoff, for any reason, temporary or permanent full-time employees shall be laid off in the inverse order of their seniority in their classification based on their hiring date as a full-time employee. Hearing interpreters shall not accrue seniority. In the appropriate event that a student to whom a hearing interpreter is assigned leaves the District or no longer requires a hearing interpreter, the Board may dismiss the hearing interpreter with thirty (30) days written notice, together with a statement of honorable dismissal. In the event of a layoff of a full-time interpreter, such interpreter may be called back to a new position, or existing position which becomes vacant, within one (1) calendar year from the beginning of the school term following the effective date of the layoff. If such former full-time interpreter declines the offered re- employment, such interpreter shall be removed from the recall list and the Board shall have no other recall obligation. B. Full-time employees shall be called back from layoff in their classification according to seniority based on their hiring date as a full-time employee and qualifications and so far as they are qualified to hold such a position in the classification from which they were laid off. C. Full-time employees on layoff who have been offered re-employment and have declined shall be removed from the recall list and have no other recall obligation due from the employer. D. Call back from layoff status shall extend for the following school term or within one (1) calendar year from the beginning of the following school term. E. Benefits shall not accrue during layoff. F. Not later than November 1 of each school term, the Administration shall post a listing of the seniority rank of all classified employees in their classification in the school district. Each classified employee salary scheduleshall have ten (10) employment days thereafter to file written objections to his/her ranking which shall specify the alleged error in the ranking. 1. The length of an employee's continuous full-time service in his/her classification with the employer since his/her last date of hire. An employee not completing the entry probationary period shall not be considered to have seniority and shall not be considered a regular employee. 2. Classified Employees. If a. A classified employees employee whose position is eliminated as a result of a layoff in any classification other than Maintenance Worker I shall have the right to a lower classification in the job progression ladder associated with that position, if there is one, or any position in the Bargaining Unit the employee currently or has previously held (except apprentice and trainee classifications) and for which the employee has completed the probationary period provided the employee has sufficient seniority. b. Employees who are affected by a layoff and have the right to a lower classification in their job progression ladder shall have their seniority from the Xxxxx Trace School District wish laid off classification in a classification series added to their classification seniority in the lower position for determining seniority in the lower classification in the series. Employee A’s job is eliminated so Employee A’s years of service in the Tree Trimmer Leadworker classification would be added to his/her years of service as a Tree Trimmer II to determine the seniority within the Tree Trimmer II classification. If Employee A does not have more combined years of service than the least senior employee in the Tree Trimmer II classification, then the same would be done to see if Employee A has seniority over anyone in the Tree Trimmer I classification (Employee A’s seniority in the Tree Trimmer Leadworker would be combined with the years of service as a II and a I to determine his/her seniority within the I classification). c. An employee whose position has been eliminated who has more classification seniority than another employee within that same classification shall bump the employee with the least amount of seniority within that classification in the City. Employees who are affected by a layoff and have previously held another position in the bargaining unit will bump into the previously held position based on classification seniority. d. Any employee who qualifies to bump back to a lower classification in a job progression ladder and also another previously held position not in the job progression ladder will have the right to bump back to the job in the higher labor grade, seniority permitting. e. Employees with the least classification seniority in a lower classification shall be laid off unless they shall be able, in the same manner and under similar conditions, to have the right to be considered for reemploymentplaced in a lower classification. 2. In the event an affected employee in the Blue Collar Bargaining Unit is unable to hold in a lower classification in the applicable job progression ladder, they must indicate this to or a previously held position, that employee shall be placed in the superintendentclassification of Maintenance Worker I, prior to May 1, of the year of their potential retirementCity seniority permitting. 3. Employees shall be laid off from the Maintenance Worker I classification on the basis of City Seniority. 5. Employees affected by any layoff action may: a. Exercise the option of accepting the layoff and being removed from the active payroll; or b. Accept a position in a previously held classification (except apprentice and trainee classifications), or in a lower classification in their job progression ladder, seniority permitting and provided the employee meets the qualifications for the position; or c. For employees in the Blue Collar Unit, be placed in the Maintenance Worker I classification, City seniority permitting. 6. An employee who accepts or is placed in a lower classification as a result of demotion, layoff or transfer, shall receive an hourly rate not to exceed the maximum rate for the lower classification or the employee’s current hourly rate whichever is lower. 7. Any movements in connection with the exception layoff procedures shall not result in an increase in the basic hourly rate for any employee, unless a previously held position is in a higher labor grade. 8. All layoff placements shall be made in accordance with these provisions provided the employees are able and qualified to perform the essential functions of paragraph one and two abovemeet the qualifications for the classification to which placed. 9. For any Classified employees who bump back to a temporary position shall maintain their Union-represented status for nine (9) months past the date of the employee’s position being eliminated. 10. If an employee who is less than full-timeaccepts to bump into a previously held position or lower position in a ladder and subsequently decides not to accept the bump back position, the provisions for annuities and insurance employee will be pro-rated by the Boardconsidered to have resigned.
