CLIENT and C. T. MALE ASSOCIATES agree to make every effort to resolve all claims, disputes or controversies a rising out of, or in relation to the interpretation, application or enforcement of this agreement through mediation. The parties further agree that the CLIENT will require, as a condition for participation in the project and their agreement to perform labor or services, that all contractors, subcontractors, subcontractors and material-persons, whose portion of the work amounts to five thousand dollars ($5,000) or more, and their insurers and sureties shall agree to this procedure.
CLIENT and C. T. MALE ASSOCIATES, for the mutual consideration hereinafter set forth, agree as follows: (Define Scope of Services and Schedule of Performance) Prepare and submit a 2023 NYS Water Grants Program (Drinking Water) Application to the NYS Environmental Facilities Corporation for necessary and desired replacement and other suitable upgrades to the Village’s water distribution system, as described in the Village’s Proposed Capital Projects and Equipment document and the attached Letter Proposal dated May 16, 2023. Services include coordination and submission of all application narratives, forms, exhibits and attachments for the NYS Water Grants Program (also known as WIIA) prior to the submission deadline of July 28, 2023. *Note that this Agreement does NOT include any necessary Engineering Services, preliminary design, surveying, report preparation, or other tasks necessary to supply the NYS EFC with an appropriate Engineering Report to be attached to the WIIA Application.
CLIENT and C. T. MALE ASSOCIATES, for the mutual consideration hereinafter set forth, agree as follows: (Define Scope of Services and Schedule of Performance) Prepare and submit a Grant Application to the NYS Department of Transportation for state transportation funding to be made available under the 2023-2024 Bridge NY Program to facilitate the design and reconstruction of the Route 9A Culvert (approximate address of 1225 State Route 9A) within the Village. Services include at least one project site visit to assess existing conditions and coordination and submission of all application questionnaires, narratives, forms, maps, exhibits and attachments prior to the NYSDOT submission deadline of January 19, 2024 for culvert projects, as described in the Letter Proposal dated December 11, 2023.
CLIENT and C. T. MALE ASSOCIATES, for the mutual consideration hereinafter set forth, agree as follows: (Define Scope of Services and Schedule of Performance) Prepare and submit a funding application for the Capital Improvement Grants for Pro-Housing Communities Program administered by Empire State Development Corporation (ESDC) to enable the Village of Croton-on-Xxxxxx to undertake pedestrian sidewalk and streetscaping infrastructure and potential blight removal project work to improve pedestrian and bike safety, upgrade connections to business districts including Uptown and along North and South Riverside Avenues, and attract more economic and housing investments to the Village. Services include coordination and submission of all ESDC application narratives, exhibits and attachments necessary for the application submission to the State through the Consolidated Funding Application portal by July 31, 2024.
