COLOR SELECTIONS. If Seller chooses to offer color selections for the standard appliances or any other standard items in the Unit, then, Buyer agrees to make such selections within five (5) business days after receipt of written notice from Seller or Seller’s agent requiring Buyer to make such selections. Buyer expressly acknowledges and agrees that if Buyer fails to make such selections within the allotted time period, Seller shall be authorized to make the color selections on behalf of Buyer, and Buyer hereby affirms such selections. If any of the color selections become unavailable for any reason, Buyer agrees to select, within five (5) business days after notice thereof, another color selection from the alternative choices offered by Seller, or have the selections made by Seller as aforesaid. Buyer expressly agrees that the unavailability of any original color selection shall have no effect on Buyer's obligations hereunder and shall not in any way constitute grounds for any claim whatsoever against Seller, and Buyer expressly waives any rights, claims or actions which it might otherwise have against Seller as a result of such circumstances.
