COLOUR AND MATERIAL SELECTION a) Wherever in this Agreement the Purchaser has the right to choose colours or materials, he shall do so within ten (10) days after notification by the Vendor and the Purchaser shall make his selection of such colours and/or materials, whatever the case may be, from the Vendor’s samples and list same on the Vendor’s colour selection form.
COLOUR AND MATERIAL SELECTION. The Purchaser shall conduct its choice of colours and materials in the manner set out by the Vendor in its sole, absolute and unfettered discretion, including without limitation, by electronic mail or similar electronic transmission, mail, personal attendance at a time and location designated by the Vendor in its sole, absolute and unfettered discretion.

(a) Wherever in this Agreement the Purchaser has the right to choose colours or materials, which choices relate to the Dwelling’s interior features and/or finishes only (it being understood that the Purchaser shall have no option to choose colours or materials relating to the exterior features of the Dwelling), he shall do so within ten (10) days after notification by the Vendor and the Purchaser shall make his selection of such colours and/or materials, whatever the case may be, from the Vendor's samples and list same on the Vendor's colour selection form, which selections shall be made at the Vendor’s sales centre(s) or such other virtual sales and/or décor centre(s) designated by the Vendor at its sole option from time to time.
COLOUR AND MATERIAL SELECTION. 38. The Purchaser covenants and agrees that he shall pay to the Vendor in advance for all extras, upgrades or changes ordered by the Purchaser (collectively, “Extras” and individually, an “Extra”) at the time such order is made and the Purchaser further acknowledges and agrees that such payment is non-refundable in the event that his transaction is not completed as a result of any default hereunder of the Purchaser. If any Extra is not completed or installed on or before the Closing Date, the Purchaser shall complete this transaction notwithstanding the non-completion or non-installation of the Extra provided that the provisions of Section “Ontario Building Code - Conditions of Closing” of Schedule B - Tarion have been complied with. If any Extra that has been included in this Agreement and for which no amount has been individually allocated and such Extra has not been completed or installed in the Dwelling on the Closing Date, then, the Purchaser shall receive on Closing a credit for such Extra in an amount determined by the Vendor, in its sole and absolute discretion. The Purchaser shall not be entitled to any credit for any Extra that is included in this Agreement if the Purchaser subsequently elects to alter, replace or delete such Extra. The Purchaser further acknowledges and agrees that the amount so paid to the Purchaser (or for which, in the alternative, the Purchaser receives credit in the statement of adjustments) shall be accepted by the Purchaser as full and final settlement of any claim by the Purchaser with respect to the extras, upgrades or changes which remain incomplete as aforesaid. The Purchaser further acknowledges that the Vendor's liability with respect to such incomplete Extras, shall be limited to the return of the amounts referred to aforesaid and, thereafter, there shall be no further liability upon the Vendor in connection with such incomplete Extras and upon such payment being made or credit being given, the Vendor shall be deemed to have been released from any and all obligations, claims or demands whatsoever with respect to such incomplete Extras. If the Purchaser neglects to advise the Vendor forthwith upon request as to the Purchaser's selection of finishing specifications, or orders any extras, upgrades in interior finishings, or performs any work in or about the Dwelling which causes delay in the Vendor's construction operations, the Vendor may require the Purchaser to complete this transaction on the Closing Date herein s...

(a) Wherever in this Agreement that the Purchaser has the right to choose colours or materials, the Purchaser shall do so by appointment at the Vendor’s sales office for the subject project (or such other location that may apply from time to time) within 7 days after notification by the Vendor. The Purchaser shall make his selection of such colours and/or materials, whatever the case may be, from the Vendor's samples at the Vendor’s sales office for the subject project (or such other location that may apply from time to time) and list same on the Vendor's colour selection form. While attending his appointment at the Vendor’s sales office for the subject project (or such other location that may apply from time to time), the Purchaser shall be bound by and shall observe and perform all reasonable rules and regulations made by the Vendor from time to time and of which notice in writing shall be given to the Purchaser prior to the Purchaser’s appointment, and all such rules and regulations shall be deemed to be incorporated into and form part of this Agreement, provided that the Purchaser shall be given reasonable prior notice of any amendment to such rules and regulations.

(a) Wherever in this Agreement the Purchaser has the right to choose colours or materials, he shall do so within 30 days after notification by the Vendor and the Purchaser shall make his selection of such colours and/or materials, whatever the case may be, from the Vendor's samples. In the event the Purchaser fails to choose colours or materials within the aforementioned time period, the Vendor shall have the option of choosing the colours and materials and the Purchaser shall be obligated to accept same. The Purchaser shall conduct its choice of colours and materials in the manner set out by the Vendor in its sole, absolute and unfettered discretion, including without limitation, by electronic mail, by mail, by videocall/video conference, by phone call, through a website, through an electronic portal, through a computer or phone application and/or by way of personal attendance at specific location, all at a time designated by the Vendor in its sole, absolute and unfettered discretion.. The Vendor is not responsible for any errors in the selection of features, finishes, colours and materials arising from any limitations and/or restrictions in the methods, media, systems and/or technologies used to make such selections
COLOUR AND MATERIAL SELECTION. (a) Wherever in this Agreement the Purchaser has the right to choose colours or materials, he shall do so within seven (7) days after notification by the Vendor and the Purchaser shall make his selection of such colours and/or materials, whatever the case may be, from the Vendor's samples at the Vendor’s sales office, head office or décor centre for the subject project (or such other location that may apply from time to time) by way of an appointment with the Vendor or its designate and list same on the Vendor’s colour selection form. If the Purchaser fails to attend such appointment, or cancels or reschedules such appointment with less than 72 hours notice, the Purchaser shall be charged a fee of $500.00 plus Applicable Taxes on the Statement of Adjustments.

(a) Wherever in this Agreement the Purchaser has the right to select colours or materials, he shall do so within the time period specified in the notice delivered by the Vendor to the Purchaser (and no later than 10 days after the delivery of said notice) and the Purchaser shall make his selection of such colours and/or materials, whatever the case may be, from the Vendor's samples at the Vendor’s sales office for the subject project (or such other location that may apply from time to time) and list same on the Vendor's colour selection form. The Purchaser acknowledges that the Vendor's scheduling requirements are paramount, and that the Purchaser will be required to attend at times and locations selected by the Vendor as specified on written notice and a failure to attend for the appointment on the date and time fixed by the written notice is an act of default hereunder. The Purchaser acknowledges that any delay in making selections and/or reselections may prejudice the Vendor's construction schedule and/or delay the closing date. Except for direct orders from suppliers, all selections must be made on the Vendor's form of agreement, and will be made under the Vendor's usual terms and conditions, which govern payment, selections, substitutions, completion, credits, refunds, and limitations on selections, which terms and conditions are binding on the Purchaser.

(a) Within 7 days of notification by the Vendor to the Purchaser, the Purchaser shall complete the Vendor's colour and material selection form for those items of construction and finishing for which the Purchaser is entitled to make selection pursuant to this Agreement, including where applicable and permitted by the Vendor and the Municipality, exterior colours, and in the event such items become unavailable, the Purchaser agrees to re-attend within 7 days of notification to make alternate selections from the Vendor's samples. If the Purchaser fails to attend and make selections as aforesaid, the Vendor may make the selections on the Purchaser's behalf and the Purchaser agrees to accept the Vendor's selections.
