Construction Operations. Limited to areas required for new construction. No area outside construction limits may be used for any purpose by the Service Providers contractor or subcontractors. Contractors shall provide temporary partitions to prevent pedestrian traffic through work area when any work is required in corridors or beyond construction operations. a) Contractors shall confine their equipment, storage of materials and operations of their workmen to area of work, and shall not bring materials onto site until reasonably required for progress of Work. b) Storage space will be confined to area of Work. MPS assumes no responsibility for materials stored in building or on site. Contractors assume full responsibility for damage due to storing of materials.
Construction Operations. Construction operations shall be planned and organized to minimize conflicts with railroad operations. All operations are to be conducted in accordance with CSXT Safe Way policies and procedures, and are subject to CSXT approval. 1. Pre-construction conferences shall be held prior to beginning work on the right of way. Additional progress meetings and/or teleconferences may be required during the course of the work. Coordination shall be provided as outlined in CSXT MWI 1905. Complete work schedules will be presented at the pre-construction conference. The schedules are to be updated monthly at a minimum. 2. Construction Operations. In order to minimize the effect of construction noise on the area surrounding the improvement, the Contractor and all subcontractors shall comply with the following requirements. Any changes to this schedule will not be accepted unless approved by the Engineer. i. All engines and engine driven equipment used for hauling or construction shall be equipped with an adequate muffler in constant operation and properly maintained to prevent excessive or unusual noises. Any machine, device, or part there of which is regulated by or becomes regulated by Federal, or State of Illinois noise standard shall conform to those standards. ii. Construction operations shall be confined to the daylight hours between 7:00 AM and 5:00 PM Monday through Friday. No work of any kind shall be done outside these hours or on Saturdays or Sundays in residential areas unless previously approved by the Engineer. These time restrictions shall not apply to maintenance or operation of safety and traffic control devices such as barricades, signs, and lighting, or to construction of an emergency nature. If the Contractor requires additional time to complete a portion of the work on any given day or if he foresees the need to work extended hours for a number of days to comply with the construction schedule, they must receive the approval of the Engineer. iii. The Contractor shall take all precautions necessary to protect the general public and his employees from hazardous locations that might occur within the limits of the improvements. Neither the Village nor the Engineer is responsible for site safety. The Bidder is solely and exclusively responsible for construction means, methods, technologies, and site safety. iv. It shall be the Contractor's responsibility to protect open cut trenches as may be required by OSHA, Illinois Department of Labor, State, or Federal Law. Trenches in pavements or in close proximity to the improved streets or roadways shall be sheeted or braced in a substantial and effective manner. Sheeting may be removed after backfilling has been completed to such an elevation as to permit its safe removal. Sheeting and bracing left in place must be removed for a distance of 3 feet below the established street grade. The cost of furnishing, placing, and removing sheeting and/or bracing shall be incidental to construction and included in the contract unit price for the work being done. v. Construction Operations. A. Do not open the trench any further ahead of pipe laying operations than is necessary. Backfill and remove excess material immediately behind laying operations. Complete excavation and backfill for any portion of the trench in the same day. B. Construction operations shall be limited to 400 feet along the water main route, including clean-up and utility exploration. C. The Contractor shall insure that all work areas and roadways are free from excess excavated material, debris, mud, soil, rocks etc. at the end of each work day. Contractor shall be responsible for sweeping all areas at the end of each work day.

Construction Operations. 13.2.1 Constructor shall provide competent supervision of the Subcontractors and the performance of the Work. Before commencing the Work, Constructor shall notify Owner in writing of the name and qualifications of its proposed superintendent(s) and project manager so Owner may review the individual’s qualifications. If, for reasonable cause, Owner refuses to approve the individual, or withdraws its approval after once giving it, Constructor shall name a different superintendent or project manager for Owner’s review. Any disapproved superintendent shall not perform in that capacity thereafter at the Worksite. 13.2.2 Constructor shall be responsible to Owner for acts or omissions of entities performing portions of the Work for or on behalf of Constructor or any of its Subcontractors. 13.2.3 Constructor shall permit only skilled persons to perform the Work. Constructor shall enforce safety procedures, strict discipline, and good order among persons performing the Work. If Owner determines that a particular person does not follow safety procedures, or is unfit or unskilled for the assigned work, Constructor shall immediately reassign the person on receipt of Owner’s written notice. 13.2.4 Constructor shall give public authorities all notices required by Law and, except for permits and fees which are the responsibility of Owner, shall obtain and pay for all necessary permits, licenses, and renewals pertaining to the Work. Constructor shall provide to Owner copies of all notices, permits, licenses, and renewals required under this Agreement. 13.2.5 Risk Pool Members shall pay all taxes applicable to their Work.
