Commencement Date and Completion Date. Time is of the essence for performance of the Services required by this Agreement. Engineer’s Basic Services will commence upon Owner’s issuance of an initial Notice to Proceed (“Commencement Date”). Completion of the Construction Documents Phase, Construction Commencement and Completion, and Occupancy are cited in Exhibit A, Section I.A. The Completion Date for the Construction Documents Phase shall not be exceeded without the prior written approval of Owner. The Owner will agree to review all submissions in a timely fashion. If the Owner takes longer than fourteen (14) calendar days to review a submission, time for performance of services by the Engineer will be extended on a day-by-day basis for all days in excess of the fourteen (14) calendar day review period. The Completion Date will be adjusted as a result of the additional days taken by the Owner to review the submission.

Developer hereby agrees that, subject only to Force Majeure (defined below in Section 9.2), Developer shall commence construction on the Project on or before that date which is December 31, 2023 (the "Commencement Date"). Developer further agrees that, subject only to Force Majeure, Developer shall achieve Substantial Completion on or before December 31, 2025 (the "Completion Date").
Commencement Date and Completion Date. The Parties agree that the Developer’s obligation to commence with the installation and construction of the Railroad Crossings Improvements shall commence on March 1, 2022 or the commencement of the Developer’s construction work of the Cement Terminal at the Property, whichever occurs lasts (“Commencement Date”) and the completion of the Railroad Crossings Improvements shall be completed within 12 (twelve) months of the Commencement Date (“Completion Date”).

Commencement Date and Completion Date. The Commencement Date of the construction of the Project shall be 30 days from the Effective Date. The substantial Completion Date shall be 360 days from the Commencement Date but no later than the termination date of this Agreement. The project must be completed within 12 months of execution of this agreement or the project commitment is terminated, and the HOME funds must be repaid to the City.
