Construction Commencement and Completion. The Construction Documents shall contain such provisions for the protection of COPR and STWC as COPR and STWC shall deem appropriate; shall provide that the construction of the respective Project shall commence on a date certain following and subject to satisfaction of all Legal Requirements necessary to commence construction; and shall also provide that any contractor shall complete construction within such time as COPR and STWC agree following the commencement of construction. Construction Commencement and Completion. The Company shall commence construction of the Project not later than sixty (60) days following the successful procurement of all Required Permits and governmental approvals, which is preliminarily estimated to be August 31, 2022, but that date is a preliminary estimate and is subject to change due to Permitted Delays. The preliminary estimated date for the New IDI Facility Completion Date is June 30, 2024, but that date is a preliminary estimate and is subject to Permitted Delays.

Construction Commencement and Completion. If construction is not commenced within thirty-six (36) months of the execution of this Lease, this Lease shall terminate unless an extension of time is requested by the Lessee for good cause and agreed to by the Board. Subject to delays beyond the reasonable control of the Lessee, the Lessee shall substantially complete construction of the Facility and obtain a Certificate of Occupancy within twenty-four (24) months of the beginning of construction, unless an extension of time is requested by the Lessee for good cause and agreed to by the Board. All construction shall be conducted: (a) in accordance with Supplemental General Conditions attached hereto as Exhibit C; and (b) in such a way as to not disrupt the operations of the schools owned by the Board and located on property adjacent to the Leased Property (the “Schools”). The Board shall assign a project manager as its representative during the design and construction of the Facility who may inspect the Facility upon reasonable notice to Lessee and participate in project meetings. In addition, the Board shall have the right to approve the project schedule. The parties shall negotiate a coordination agreement prior to the commencement of construction work to minimize disruption to the operations of the adjacent schools, assure the safety of the school populations and public at large, and enhance schedule performance and the productivity of field operations. Upon completion of construction, Exhibit A may be replaced with a map showing the exact coordinates for the location of the leased parcel and improvements made by Lessee as mutually agreed by the Board and Lessee.
Construction Commencement and Completion. (a) The Developer shall commence construction of the Required Development Improvements within sixty (60) days after the date of Closing, weather permitting, and thereafter will diligently pursue completion of the Project. The Developer shall proceed with commercially reasonable diligence to complete construction of the Project on or before the second anniversary of the Start Date, except as such completion date may be extended by reason of Force Majeure (as defined below). The Developer shall be responsible for funding (or borrowing) and paying all costs necessary to construct and complete the Project. (b) Subject to the terms, conditions and provisions provided below, the Developer has the following general responsibilities (which are not all inclusive) for the planning, design, development, construction and installation of the Project (with the technical assistance of such qualified outside consultants as the Developer, in its discretion, may retain): (i) Securing all authorizations, permits and licenses, including those of a temporary nature, as may be necessary for the construction and intended use of the Project. (ii) Providing, either alone or in conjunction with the Developer's advisers and consultants, the appropriate coordination of all planning and construction of the Project, including the directing and scheduling of construction, all field inspections, tests, surveys and other activities related to the Project. (iii) Providing qualified field personnel for inspecting and reviewing the Project progress and construction of the Project, including final inspection and certification by Developer that, to the best of its knowledge, all work, as constructed, conforms with the approved Final Project Documents. (iv) Providing documentation to the satisfaction of the City of all contractor licenses.
