Compensation for Statutory Holidays. Full-time Employees (a) When a regularly scheduled day of work for a full-time employee falls on a statutory holiday referred to in paragraph 20.01 (a) and the employee is required to work, the employee shall work his or her scheduled hours and shall be compensated in T.O.I.L, as defined in Article 18.04, at a one and one-half (1.5) times rate, plus public holiday pay in accordance with Ontario’s Employment Standards Act. Such lieu shall be taken at a time as mutually agreed between such employee and the Employer. (b) When a regularly scheduled day of work for a full-time employee falls on a statutory holiday referred to in paragraph 20.01 (a) and the employee is not required to work, the employee will receive public holiday pay in accordance with Ontario’s Employment Standards Act. (c) When a holiday occurs on a non-working day for the employee, the employee shall bank one day lieu, as defined in Article 18.04.
