Compensatory Leave for Sworn Officers and. Civilian Directors Effective January 1, 2002, in consideration of hours worked in excess of an employee’s regular hours, except as provided below, employees shall be granted ninety (90) hours of paid leave per year. The first forty-five (45) hours shall be credited at the end of June and the second forty-five (45) hours shall be credited at the end of December. The leave shall be taken within six months of being credited, at a time which is agreeable to the Chief. Where the leave cannot be taken within the six month period, it shall be carried over and taken as soon as possible. In the event that the employee is not at work for prolonged periods or does not work a reasonable amount of hours in excess of his regular hours during the six month period, the amount of leave to be credited shall be reduced commensurately, and such employee will be notified in writing of the reason(s) (i.e. not at work and/or did not work a reasonable amount of overtime). Notwithstanding the foregoing, where an employee did not receive the total compensatory leave available in one of the two six month periods during the year because he did not work a reasonable number of additional hours during the period, but there were extenuating circumstances requiring the employee to work an exceptional amount of overtime during the other six month period, the Chief may adjust the compensatory leave amount for the other six month period upward provided the total yearly entitlement does not exceed ninety (90) hours. At termination of employment for any reason, where it is determined that compensatory leave is owing for any portion of the six month period in which the termination occurred, it shall be credited and paid as time owing along with any other compensatory leave credited in the previous six month period but not taken.
