Special Compensatory Leave. (A) Earning of Special Compensatory Leave Credits. Special compensatory leave credits may be earned only in the following instances:
(1) By an employee in the career service for work performed on a holiday as defined in section 110.117, F.S., or for work performed during a work period that includes a holiday, as provided by the Rules of the State Personnel System.
(2) For work performed in the employee’s assigned office, facility, or region which is closed pursuant to an Executive Order of the Governor or any other disaster or emergency condition in accordance with Rule 60L-34.0071, F.A.C.
(B) General Provisions for Using Special Compensatory Leave Credits in Accordance with Rule 60L-34.0044, F.A.C.
Special Compensatory Leave. (A) Special Compensatory Leave is defined as leave that is earned as provided in Rule 60L-34, Florida Administrative Code, for hours worked on a holiday, extra hours worked during an established work week which contains a holiday, or extra hours worked when the employee’s assigned office, facility, or region is closed pursuant to an Executive Order of the Governor or any other disaster or emergency condition.
Special Compensatory Leave. (A) Earning of Special Compensatory Leave Credits. Special compensatory leave credits may be earned only in the following instances:
(1) By an employee in the career service for work performed on a holiday as defined in section 110.117, Florida Statutes, or for work performed during a work period that includes a holiday, as provided by the Rules of the State Personnel System.
(2) By an employee in the career service for work performed in the employee’s assigned office, facility, or region which is closed pursuant to an Executive Order of the Governor or any other disaster or emergency condition.
(B) Special Compensatory Leave Earned Prior to July 1, 2012 An employee may be required to reduce special compensatory leave credit balances.
(C) Special Compensatory Leave Earned On or After July 1, 2012
(1) Special compensatory leave credits earned, as described in subsection (A)(1), on or after July 1, 2012, which are not used each year by the April 30 or October 31 that immediately succeeds the work period in which the leave is credited, whichever date occurs earlier, shall be forfeited.
(2) Special compensatory leave credits earned, as described in subsection (A)(2), on or after July 1, 2012, which are not used within 120 calendar days from the end of the work period in which the leave is credited shall be forfeited.
(3) Each agency shall schedule employees earning special compensatory leave credits in a manner that allows all such leave credits earned on or after July 1, 2012, to be used within the time limits specified in subsections 1 and 2. However, if scheduling such leave within such time limits would prevent the agency from meeting minimum staffing requirements needed to ensure public safety, the Agency Head may extend the time limits specified in subsections 1 and 2 for up to an additional 180 calendar days. Extensions will not be allowed for any other reason.
(4) No agency may make a payout of unused special compensatory leave credits earned on or after July 1, 2012.
(D) Unless otherwise prohibited by law or rule, all requests for use of approved leave, other than administrative leave, shall first be charged to any special compensatory leave credits the employee has accrued.
Special Compensatory Leave. (A) Special Compensatory Leave is defined as leave that is earned as a result of hours worked on a holiday, extra hours worked during an established work week which contains a holiday, or extra hours worked when a facility is closed under emergency conditions as provided in Rule 60L-34, F.A.C.
Special Compensatory Leave. (A) Earning of Special Compensatory Leave Credits. Special compensatory leave credits may be earned only in the following instances:
Special Compensatory Leave. A. An employee may accumulate up to one hundred and twenty (120) hours of special compensatory leave except that unused special compensatory leave may be paid for by the University at any time.
B. When an employee has accumulated in excess of one hundred and twenty (120) hours of special compensatory leave, the supervisor may require an employee to use any part of the employee's accrued special compensatory leave in increments of eight (8) hours or in increments equivalent to the number of hours of work in an employee's regularly scheduled workday. Normally, an employee will be given fourteen {14) days' notice when required to use special compensatory leave in an increment in excess of forty (40) hours, and seven (7) days' notice when required to use special compensatory leave in an increment of sixteen (16) to forty (40) hours.
Special Compensatory Leave. A. An employee may accumulate up to 240 hours of special compensatory leave except that unused special compensatory leave may be paid for by the University at any time.
B. When an employee has accumulated in excess of 240 hours of special compensatory leave, the supervisor may require an employee to use any part of the employee’s accrued special compensatory leave in increments of 8 hours or in increments equivalent to the number of hours in an employee’s regularly scheduled workday. Normally, an employee will be given 14 calendar days’ notice when required to use special compensatory leave in an increment in excess of 40 hours, and 7 calendar days’ notice when required to use special compensatory leave in an increment of 16 to 40 hours.
C. Employees working during an emergency closing of the University of Florida will receive Special Compensatory Leave based on an hour for hour worked.

(1) Despite the fact that previous collective bargaining agreements only permitted employees to accumulate a maximum of 240 hours of special compensatory leave credits, certain employees may have earned hours prior to July 1, 2012 in excess of that amount. Nothing in this agreement is intended to address the validity or invalidity of special compensatory leave credits above 240 hours earned prior to July 1, 2012.
(2) An employee may be required to reduce special compensatory leave credit balances.

(B) General Provisions for Using Special Compensatory Leave Credits Earned On or After November 1, 2014 in Accordance with Rule 60L-34.0044, F.A.C.
(1) Special compensatory leave credits as described in (A)(1) earned on or after November 1, 2014 are to be used each year by the April 30 or October 31 that immediately succeeds the work period in which the leave is credited, whichever date occurs earlier.
(2) Special compensatory leave credits as described in (A)(2) earned on or after November 1, 2014 are to be used within 120 calendar days from the end of the work period in which the leave is credited.
(3) Each agency shall schedule employees earning special compensatory leave credits in a manner that ensures that all leave credits earned on or after November 1, 2014 are used within the time limits specified in (B)(1) and (2). However, if the agency is unable to schedule such leave within these time limits, the agency shall extend the time limits for an additional 180 calendar days. All leave credits earned on or after November 1, 2014 shall be used prior to any pre-November 1, 2014 credits.
(4) If any leave credits earned on or after November 1, 2014 remain at the end of the extended period, the employee shall be paid for such unused leave at the employee’s current regular rate of pay.
Special Compensatory Leave. A. An employee may accumulate up to two hundred and forty hours of special compensatory leave. The University may pay for a specified amount of unused special compensatory leave at any time when the employee’s balance is over 240 hours. The amount of payment to the employee will only bring the employee’s balance back to 240 hours. If the University decides to pay for a specified amount of unused special compensatory leave, the employee cannot request to keep the special compensatory leave instead of being paid. The University will provide fourteen days’ notice when paying for the special compensatory leave as specified in this paragraph.
B. When an employee has accumulated in excess of two hundred and forty hours of special compensatory leave, the supervisor may require an employee to use any part of the employee's accrued special compensatory leave in increments of twelve hours or in increments equivalent to the number of hours of work in an employee's regularly scheduled workday. Normally, an employee will be given fourteen days' notice when required to use special compensatory leave as specified in this paragraph.
C. If an employee is eligible to earn special compensatory leave, the Division Head may pay the employee for any or all of the employee’s accrued special compensatory leave under special circumstances such as a natural disaster or winter break. When this is approved, the employee cannot elect to keep the accrued compensatory leave in lieu of payment. The Division Head will notify eligible employees in writing of this special circumstance.
