Complete Construction Documents. Developer shall prepare and submit a complete set of Construction Documents for the Improvements in each Phase (excluding tenant improvements) to the City staff within the time established therefore in the Schedule of Performance, for review. The Complete Construction Documents shall incorporate any conditions for approval of the Design Development Drawings, and shall otherwise be a logical evolution of, and consistent with the Design Development Drawings. The Complete Construction Documents shall be the construction documents for which the City will issue a building permit and/or any other permits required for the development of the Phase. The Complete Construction Documents shall include, but not be limited to: (i) final site plans; (ii) final landscape plans and specifications, including plant materials, irrigation plan, landscape details, and hard-scape; (iii) floor plans; (iv) exterior elevations; (v) graphics and signage; (vi) exterior details; (vii) material samples; (viii) final specifications; (ix) structural drawings; (x) all parking facilities improvements construction details; (xi) final right-of-way plans, including street furniture, street lighting, paving, etc.; (xii) utilities plan;
Complete Construction Documents. Tenant shall submit Construction Documents including the list of bid alternates, if any, to Landlord in accordance with the Schedule. The Landlord shall review and approve, which approval shall not be unreasonably withheld, the Construction Documents with reasonable conditions, if any, within ten (10) business days of receipt of the Construction Documents. Tenant shall comply with the Landlord's conditions, if any, by modifying the Construction Documents prior to the issuance of a building permit. 42
Complete Construction Documents. For purposes of the Contract Documents, Construction Documents shall be deemed 100% complete once they have been stamped “issued for permit” or “issued for construction” by the DB Contractor’s appropriately licensed and qualified Design Professional and have been approved by the Authority in writing. Once any of the 100% complete Construction Documents have been approved by the Authority, the Authority and the DB Contractor shall execute a complete set of the same. Upon such execution, such Construction Documents shall thereupon be deemed a part of the Contract Documents. Once approved, the DB Contractor may not modify, alter, or change any of the 100% complete Construction Documents without the Authority’s prior written approval.

  • Initial Construction Attached hereto are plans showing proposed modifications to Premises. Within 20 days of execution of the Lease, Landlord will prepare construction drawings and specifications for such modifications containing such details as dimensions, partition plans, dimensioned electrical and telephone outlet plans, modified reflected ceiling plans, room finish schedule, including wall, carpet, floor tile, and VCT colors, and other necessary construction details and specifications for the completion of such work, all in a manner reasonably acceptable to Tenant. In addition, in Tenant's construction contract, Tenant shall insure that the contract holds Landlord and The Gutixxxxx Xxxpany harmless, and that Landlord and The Gutixxxxx Xxxpany are additional named insureds on all of Tenant's insurance policies. It shall be Tenant's contractor's responsibility to obtain the building permit for said modifications to Premises. It shall be Tenant's responsibility to insure that all Tenant's general contractors subcontractors and materialmen are paid in full, and if a lien is placed upon the Building by any such contractor, subcontractor, materialmen, or other, to promptly remove such lien or provide a bond reasonably satisfactory to Landlord and Landlord's mortgagee to insure that such lien will be paid in full while contesting such lien. Landlord shall permit Tenant and Tenant's contractor access for construction of modifications to Tenant's premises promptly after execution hereof. All changes and additions shall be part of the Building, except such items as by writing at the time of approval the parties agree either shall be removed by Tenant on termination of this Lease, or shall be removed or left at Tenant's election.

  • Effect on Transaction Documents Except as expressly set forth above, all of the terms and conditions of the Transaction Documents shall continue in full force and effect after the execution of this Agreement and shall not be in any way changed, modified or superseded by the terms set forth herein, including, but not limited to, any other obligations the Company may have to the Purchaser under the Transaction Documents. Notwithstanding the foregoing, this Agreement shall be deemed for all purposes as an amendment to any Transaction Document as required to serve the purposes hereof, and in the event of any conflict between the terms and provisions of the Debentures or any other Transaction Document, on the one hand, and the terms and provisions of this Agreement, on the other hand, the terms and provisions of this Agreement shall prevail.
