Completion of the Interim Work. Completion of the Interim Work means the completion of the Interim Work in accordance with this Contract and includes the requirement that: the provisions of GC5.4A – COMPLETION OF THE INTERIM WORK are satisfied, that occupancy of the Interim Work must be available to the Owner in accordance with applicable law, rules, regulations or ordinances applicable to the Place of the Work and for greater certainty means that the preliminary Commissioning of the Interim Work as required in the Contract Documents to be completed for Completion of the Interim Work to be achieved has been successfully completed in accordance with GC 13.3 - COMMISSIONING AND THE ROLE OF THE COMMISSIONING AGENTS but final Commissioning of the Interim Work is not required including to the extent any component of the Commissioning of the Interim Work is delayed due to seasonal requirements or cannot practically be achieved prior to occupancy and use or is delayed as a result of Owner caused delay in the procurement of any equipment to be incorporated into the Interim Work.

Completion of the Interim Work. Completion of the Interim Work means the completion of the Interim Work in accordance with this Contract and includes the requirement that: (i) the Contractor has performed its obligations in GC5.4A – COMPLETION OF THE INTERIM WORK; (ii) the Interim Work is available for occupancy by the Owner in accordance with the standards for occupancy set out in the Ontario Building Code and the requirements of local municipal building authorities in the City of Mississauga or is actually being used by the Owner for the purpose for which it is intended; and (iii) the preliminary Commissioning of the Interim Work has been completed in accordance with the Contract Documents to the extent required to meet the requirements for occupancy of the Interim Work set out in the Ontario Building Code, and the building services required for the Owner to carry out its Commissioning activities with respect to the Interim Work are available in accordance with the specifications, but final Commissioning of the Interim Work is not required including to the extent any component of the Commissioning of the Interim Work is delayed due to seasonal requirements or cannot practically be achieved prior to occupancy and use or is delayed as a result of Owner caused delay in the procurement of any equipment to be incorporated into the Interim Work.
Completion of the Interim Work. (a) Project Co shall deliver a notice of the date anticipated to be the Interim Completion Date to Owner and the Consultant at least 90 days prior to the date anticipated by Project Co to be the Interim Completion Date. Project Co acknowledges that Owner needs a minimum of 90 days notice prior to the anticipated Interim Completion Date to prepare for Commissioning. Project Co shall advise Owner and the Consultant of any change in the anticipated date. Project Co shall, by the date which is 20 days prior to the anticipated Interim Completion Date as set out in Project Co‟s notice, prepare a list, in electronic format on software that identifies deficiencies by division, trade and location (“Interim Preliminary Minor Deficiencies List”) of Minor Deficiencies, including an estimate of the cost of and the time for rectifying such Minor Deficiencies.
Completion of the Interim Work. Completion of the Interim Work means that:

  • Completion of the Work The Contractor must obtain Material Completion as defined in Section 6.1.2 below prior to any occupancy of the Project.

Subject to payment of such Damages, the Concessionaire shall be entitled to a further period not exceeding 120 (one hundred and twenty) days for completion of the Punch List items. For the avoidance of doubt, it is agreed that if completion of any item is delayed for reasons solely attributable to the Authority or due to Force Majeure, the completion date thereof shall be determined by the Independent Engineer in accordance with Good Industry Practice, and such completion date shall be deemed to be the date of issue of the Provisional Certificate for the purposes of Damages, if any, payable for such item under this Clause 14.4.1.

  • Completion of Project The Borrower shall carry out the Project in accordance with the Technical Description as may be modified from time to time with the approval of the Bank, and complete it by the final date specified therein.

Additionally, any portion of the Investment not used and accounted for in accordance with this Agreement as of the Project Completion Date or earlier termination is repayable by the Applicant to AI at AI’s request.
