MDE Energy Plant. (a) Without limiting Section 11.1 to Section 11.22, inclusive, and in addition thereto and not in substitution therefor, Project Co: (i) acknowledges and agrees: (A) that the installation, construction and commissioning of the MDE Distribution System represents work related to the Project, and such work is to be performed by Owner's own forces or Owner's other contractors (such contractors to include MDE); (B) that the development, construction, maintenance and operation of the MDE Energy Plant does not adversely interfere with Project Co's licence rights hereunder, and does not adversely interfere with Project Co's ability to perform the Work; (C) that the Specification for the phasing or sequencing of the Work to be performed under this Project Agreement is to include the coordination and scheduling of the work of Owner's own forces or Owner's other contractors (such contractors to include MDE) relating to or in respect of the development, construction, maintenance and operation of the MDE Energy Plant with the Work; and (D) that the Site is subject to the MDE Distribution System Easement, and that Owner shall have the right to use and access the Construction Lay Down Areas (as such term is defined in the MDE Ground Lease) and such other areas of the Site as Project Co and Owner, each acting reasonably, may agree upon from time to time for the storage of construction equipment and materials, usage by the suppliers, contractors and workers and for parking of all types of vehicles and construction equipment relating to or in respect of the development, construction, maintenance and operation of the MDE Energy Plant; and (ii) agrees to: (A) coordinate the Work so as to not interfere, interrupt, obstruct, delay or otherwise affect the work of Owner's own forces or Owner's other contractors (such contractors including MDE) relating to or in respect of the development, construction, maintenance and operation of the MDE Energy Plant; (B) comply with all rules and directives issued by Owner regarding the development, construction, maintenance and operation of the MDE Energy Plant; (C) ensure that at all times Owner has full and unobstructed access to the MDE Distribution System Easement Lands over the portions of the Site adjoining the MDE Distribution System Easement Lands; (D) ensure that the surface of the MDE Distribution System Easement Lands remains clear of and unencumbered by buildings, structures and improvements due to any act or omission of Project Co...

  • Electric Storage Resources Developer interconnecting an electric storage resource shall establish an operating range in Appendix C of its LGIA that specifies a minimum state of charge and a maximum state of charge between which the electric storage resource will be required to provide primary frequency response consistent with the conditions set forth in Articles 9.5.5, 9.5.5.1, 9.5.5.2, and 9.5.5.3 of this Agreement. Appendix C shall specify whether the operating range is static or dynamic, and shall consider (1) the expected magnitude of frequency deviations in the interconnection; (2) the expected duration that system frequency will remain outside of the deadband parameter in the interconnection; (3) the expected incidence of frequency deviations outside of the deadband parameter in the interconnection; (4) the physical capabilities of the electric storage resource; (5) operational limitations of the electric storage resources due to manufacturer specification; and (6) any other relevant factors agreed to by the NYISO, Connecting Transmission Owner, and Developer. If the operating range is dynamic, then Appendix C must establish how frequently the operating range will be reevaluated and the factors that may be considered during its reevaluation. Developer’s electric storage resource is required to provide timely and sustained primary frequency response consistent with Article 9.5.5.2 of this Agreement when it is online and dispatched to inject electricity to the New York State Transmission System and/or receive electricity from the New York State Transmission System. This excludes circumstances when the electric storage resource is not dispatched to inject electricity to the New York State Transmission System and/or dispatched to receive electricity from the New York State Transmission System. If Developer’s electric storage resource is charging at the time of a frequency deviation outside of its deadband parameter, it is to increase (for over-frequency deviations) or decrease (for under-frequency deviations) the rate at which it is charging in accordance with its droop parameter. Developer’s electric storage resource is not required to change from charging to discharging, or vice versa, unless the response necessitated by the droop and deadband settings requires it to do so and it is technically capable of making such a transition.

  • Energy Cooperation shall focus on: (a) renewable energy; (b) promoting the saving of energy; (c) applied research relating to networks of databases linking the two Parties' economic and social operators; (d) backing efforts to modernise and develop energy networks and the interconnection of such networks with Community networks.

  • Energy Conservation The Contractor agrees to comply with mandatory standards and policies relating to energy efficiency which are contained in the state energy conservation plan issued in compliance with the Energy Policy and Conservation Act.

  • Energy Efficiency The contractor shall comply with all mandatory standards and policies relating to energy efficiency which are contained in the energy conservation plan issued in compliance with the Energy Policy and Conservation Act (Pub.L. 94-163) for the State in which the work under this contract is performed.

  • Pipelines Developer shall have no interest in the pipeline gathering system, which gathering system shall remain the sole property of Operator or its Affiliates and shall be maintained at their sole cost and expense.

  • Interconnection Facilities Engineering Procurement and Construction Interconnection Facilities, Network Upgrades, and Distribution Upgrades shall be studied, designed, and constructed pursuant to Good Utility Practice. Such studies, design and construction shall be based on the assumed accuracy and completeness of all technical information received by the Participating TO and the CAISO from the Interconnection Customer associated with interconnecting the Large Generating Facility.

  • Plant The expression ‘Plant’ as used in the tender papers shall mean every temporary accessory necessary or considered necessary by the Engineer to execute, construct, complete and maintain the work and all altered, modified, substituted and additional works ordered in the time and the manner herein provided and all temporary materials and special and other articles and appliance of every sort kind and description whatsoever intended or used therefore.

  • Energy Policy and Conservation Act Both parties hereby agree to comply with all mandatory standards and policies relating to energy efficiency, which are contained in the state energy conservation plan issued in compliance with the Energy Policy and Conservation Act (Pub. L. 94-163, 89 Stat. 871).

  • Gas If Customer has selected a Gas Fixed Rate, Customer’s Price will be based on the Fixed Rate(s), plus the Administration Charge, set forth in the Application, which includes RITERATE ENERGY’s compressor fuel and transportation charges, administrative and transaction costs and the Gas Balancing Amount and any Regulatory Charges (defined below).

  • Generating Facility The Interconnection Customer’s device for the production of electricity identified in the Interconnection Request, but shall not include the Interconnection Customer’s Interconnection Facilities.
