Compliance with OSHA. Contractor shall comply with all applicable provisions of the Occupational Safety and Health Act throughout the duration of the Project. Contractor shall also comply with all applicable laws, statutes, regulations, ordinances, codes, orders, rules and regulations in existence as of the date of this Agreement.
Compliance with OSHA. Worksite Supervisor, Service Provider, and FRWDB shall, consistent with the manner described in this section, comply with all federal and state OSHA regulations, which apply to the youth assigned to Worksite Supervisor’s location. The following describes the general obligations of worksite employer with regard to OSHA compliance:
a. FRWDB and/or Service Provider shall provide that its employees are trained in general safe work practices prior to commencement of services for Worksite Supervisor. Worksite supervisor shall provide that the youth are trained with regard to the specific hazards of and safe work practices before commencing such work and/or training.
b. FRWDB and/or Service Provider may inspect Worksite Supervisor’s worksite before assigning youth to work there. Fresno Area Workforce Investment Corporation and/or Service Provider may do so thereafter on a periodic basis, with prior notification.
c. Upon request by FRWDB and/or Service Provider the Worksite Supervisor will provide documentation of the completion of their OSHA obligations under this section. Worksite Supervisor will include training in its exposure monitoring and sampling programs for the purpose of quantifying employee exposures to chemical, physical, and biological hazards in the youths’ assigned tasks. Worksite Supervisor will inform youth of the results of such monitoring and sampling in accordance with OSHA requirements. FRWDB, Service Provider, and any youth will be informed of any suspected or known employee exposure in excess of OSHA permissible exposure limits, immediately following Worksite Supervisor’s first knowledge of such overexposure.
Compliance with OSHA. The Xxx Entities are in compliance in all respects with all applicable provisions of the Occupational Safety and Health Act of 1970, as amended, including all applicable regulations thereunder, except for such noncompliance as would not, individually or in the aggregate, have a Material Adverse Effect.
Compliance with OSHA. To the extent that it can, within fiscal and logistic constraints, the District shall comply with the provisions of the California Occupational Safety and Health Act, as amended, and regulations relating thereto.
Compliance with OSHA. Borrower is in compliance with OSHA, unless failure to comply or maintain would not reasonably be expected to have a Material Adverse Effect on Borrower.
Compliance with OSHA. Borrower covenants and agrees that it will comply with the requirements of the Occupational Safety and Health Act (“OSHA”), as the same may be amended from time to time, during the entire term of the Loan and that it will comply with any requirements established by any federal, state or local governmental authorities having jurisdiction over such matters. All operations, maintenance, renovation, repair and construction conducted on the Project shall all be completed in accordance with OSHA. Failure to comply with the provisions of OSHA shall constitute an Event of Default and shall entitle the Lender to exercise all remedies available to it hereunder.
Compliance with OSHA. To the Knowledge of Phoenix, the Assets and Business (a) are and have been operated in substantial compliance with all applicable Occupational Safety and Health Laws, (b) are not the subject of any pending written notice from any governmental entity alleging the violation of any Occupational Safety and Health Law, and (c) are not currently subject to any court order, administrative order, decree, notice or citation arising under any Occupational Safety and Health Law.
Compliance with OSHA. Accuride shall be reasonably satisfied that Kaiser has taken all actions necessary to bring the Real Property and the facilities located thereon into compliance with "confined space" regulations under the Occupational Health and Safety Act of 1970, as amended.
Compliance with OSHA. As TLHD has ultimate control over the facilities in which Adventist Health Employees work during the term of this Agreement, TLHD agrees that it is ultimately responsible for maintaining a safe worksite in compliance with the Occupational Safety and Health Act (“OSHA”) and comparable state laws and regulations thereunder, to the extent those laws apply to Adventist Health Employees assigned to the Hospital's worksite, except that during the term of the MSA, the terms of the MSA shall control with respect to any potential liability under OSHA. Any such agreement shall be included as an addendum to this Agreement.
Compliance with OSHA. Bidder agrees that all item(s) offered comply with all applicable Federal and the State Occupational Safety and Health Act, laws, standards and regulations, and that Bidder will indemnify and hold the Mt. Diablo Unified School District harmless for any failure to so conform.
