Continuous Service Pay. For members of the bargaining unit who complete twenty (20) years of service as an employee of the City of Hayward on or after January 1, 2006, the member shall receive a two percent (2%) Continuous Service Pay on the member’s 20th anniversary and an additional one percent (1%) Continuous Service Pay on each succeeding anniversary to and including the member’s 30th anniversary. Members of the bargaining unit with more than 20 years of service as of January 1, 2006 shall receive Continuous Service Pay in the amount they would have been receiving if this schedule had been in effect on the date of their 20th anniversary and thereafter.

Continuous Service Pay. For purposes of this section only, continuous paid experience with the City of Hayward that is contiguous to an employee’s most recent hire date by the City of Hayward shall be considered for the purpose of calculating continuous service and eligibility for continuous service pay. An employee with twenty-five (25) or more years of continuous service with the City of Hayward shall receive continuous service pay of two and a half percent (2.5%) above their base salary. An employee with thirty (30) or more years of continuous service with the City of Hayward shall receive additional continuous service pay of five percent (5%) for a total of seven- and one-half percent (7.5%) above their base salary. In no case shall an employee receive more than a total of seven- and one-half percent (7.5%) above their base salary on account of continuous service pay. This benefit shall be implemented effective the first full pay period following Council adoption for all then-current bargaining unit employees who meet the above years of service thresholds. Going forward, continuous service pay shall be implemented the first full pay period following the employee’s anniversary date that triggers eligibility for such pay. Continuous service pay shall be payable on employees’ regular paychecks. This Continuous Service Pay shall be reported to CalPERS as Longevity Pay Incentive Pay. The Parties acknowledge that XxxXXXX makes all final determinations as to the pensionability of any differential pay.

Continuous Service Pay. For the purpose of this Section only, continuous, paid experience in a relevant classification unique to the Hayward Police Department that is contiguous with the employee’s acceptance into the Police Academy shall be considered experience as an Officer for the purpose of calculating years of continuous service and eligibility for continuous service pay. Officers who have experience as a sworn Police Officer with the City of Hayward for fifteen (15) years or more shall be entitled to “permanent” compensation of three percent (3%) above the basic salary step currently held. Officers who have experience as a sworn Police Officer with the City of Hayward for twenty (20) years or more shall be entitled to “permanent” compensation of six percent (6%) above the basic salary step currently held. Officers who have experience as a sworn Police Officer with the City of Hayward for twenty-five (25) years or more shall be entitled to “permanent” compensation of ten percent (10%) above the basic salary step currently held. In no case will an Officer receive more than a total of ten percent (10%) above the basic salary step currently held by reason of the Officer’s continuous service, and in no case will an Officer receive more than a total of twenty percent (20%) above the basic salary step currently held by reason of the Officer’s combined continuous service and participation in the Police Education Incentive Program as outlined in Section 15.01. Employees receiving “permanent” additional compensation based on the Education Incentive structure in place prior to July 1, 2018 that is higher than the additional compensation they would be eligible for under the structure provided in this Section and Section 15.01, Police Education Incentive Program, combined, effective July 1, 2018, will have their additional compensation frozen at its current level until such time that they would be eligible for a higher benefit under this Section and Section 15.01, combined.

  • Termination of Service (a) If, prior to the Expiration Date, the Participant’s Service with the Company shall terminate (the date of termination being the “Date of Termination”) by reason of a Normal Termination (as defined in the Plan), the Options shall remain exercisable until the earlier of the Expiration Date or the day three (3) months after the Date of Termination to the extent the Options were vested and exercisable as of the Date of Termination. (b) If the Participant’s Service with the Company shall cease prior to the Expiration Date by reason of death or disability, or the Participant shall die or become disabled while entitled to exercise any of the Options pursuant to paragraph 3(a), the Participant or the Participant’s legal representative, or, in the case of death, the executor or administrator of the estate of the Participant or the person or persons to whom the Options shall have been validly transferred by the executor or administrator pursuant to will or the laws of descent and distribution, shall have the right, until the earlier of the Expiration Date or one year after the date of death or disability, to exercise the Options to the extent that the Participant was entitled to exercise them on the date of death or disability. (c) If, prior to the Expiration Date, the Participant’s Service with the Company is terminated for “Cause” (as defined in the Plan), (i) unless otherwise provided by the Committee, the Options, to the extent not exercised as of the Date of Termination, shall lapse and be canceled, and (ii) all shares of Common Stock received pursuant to an exercise of the Options after such termination, in contravention of subsection (i) above, may be purchased by the Company at its discretion for the exercise price of such shares paid by the Participant. If the Participant’s Service relationship with the Company is suspended pending an investigation of whether the Participant shall be terminated for Cause, all the Participant’s rights with respect to the Options shall be suspended during the period of investigation. (d) If, prior to the Expiration Date, the Participant’s Service with the Company is terminated other than for Cause, a Normal Termination, death or disability, the Options, to the extent then vested and exercisable as of the Date of Termination, shall remain exercisable until the earlier of the Expiration Date or thirty (30) days after the Date of Termination. (e) After the expiration of any exercise period described in any of Sections 3(a) - (d) hereof, or otherwise upon the Expiration Date, the Options shall terminate together with all of the Participant’s rights hereunder, to the extent not previously exercised.
