Controlled Substance Test method for determining the presence of controlled substances in a urine sample using a scientifically reliable method performed in accordance with procedures specified in 49 CFR part 40, as amended. Conviction – finding of guilt (including a plea of nolo contendere) or imposition of sentence, or both, by any judicial body charged with the responsibility to determine violations of Federal, State, or City drug laws. Counseling – participation in a substance abuse counseling program provided through the City of Yakima Employee Assistance Program (EAP).
