Coordination with Medicare. 2.9.9.1 The CONTRACTOR is responsible for providing medically necessary covered services to members who are also eligible for Medicare if the service is not covered by Medicare.
Coordination with Medicare i. Medicare due to age If an insured has Medicare due to age (older than sixty-five (65) years), the employer plan of the insured and/or his or her spouse will be primary if the employer group to which he or she belongs to has a payroll of twenty (20) employees or more.

Executive acknowledges that this could involve, but is not limited to, responding to or defending any regulatory or legal process, providing information in relation to any such process, preparing witness statements and giving evidence in person on behalf of the Company. The Company shall reimburse any reasonable expenses incurred by Executive as a consequence of complying with his obligations under this clause, provided that such expenses are approved in advance by the Company.
